Hello,

My name is Leo,26 single and from Philippines.

I have these questions and hopefully you can advice me what to do.

I have a sister in California and she has been living there for almost 14 years now.

So these are my questions and i hope you can advice me what is best to do.

Im planning or we are planning to go to the US but i dont know what to do first.

1) What should i apply or what kind of visa

2) How long is the processing?

3) Where is easier to process,my mother or mine? then if mother,how long or years would it take?more likely

4) If my sister will apply for a petition for me,how long do i have to wait until its done.

5) Is there any other way to make processing quicker or easier?

I hope you can advice ...I will be checking my emails for your responses...Thank you...

Hello,

Answer

1) To Immigrant visa? Your US Citizen sister's petition it would be FB F4 and if your mom it would be FB F1 if a US Citizen or FB F2B if she had a green card.

2) F4 = 23 years , F1 = 16 years or F2B = 12 years.

3a) Think I'm lost but your mom is living in the Philippines too and you want to know how long if your sister petition for her? If yes - it will take 8-10 months (without delays)

3b) If your mom come here then petition for you it will be QUICKER.

4) If your sister apply for you it will take about hmmm 23 years

5) There would be no way make processing case quicker or easier. You will be categorized in the Family Based Visas and so you will have to wait until a visa is there for you.

Yes my mom is still here in the Philippines,She has a passport already.

So you said it would take 8 months for her...Then if she arrived there,so how many years my mom has to wait for her to apply to get me? then how long would be the the processing?

Please advice...thank you very much...

By the way,may i know why you know these stuffs? did you have experience or youre working in an immigration?

She can apply for you the same day she arrives in the USA.The processing would be about 11-12 years.

By the way,may i know why you know these stuffs? did you have experience or youre working in an immigration?

I'm very familiar with the family immigration process.

If your Sister is a green Card Holder ( Permanent Resident) then she will not be able to apply for you. She Must be a US Citizen.

That's funny but true J... Its gonna cause hair loss after 12 plus years annnnnnnnd dealing with the process.

if the sister is only an LPR, then she also can not petition the mom. at present time, the is no option for family based petition for the OP or his mom. the sister first would need to become a US Citizen.

if your sister is only a LPR, a resident, she cannot petition for either one of you. First she has to become a US Citizen.
