My wife is filling out the info for the Affadavit of support for the I-485. On page 4 number 25, federal tax return information. It say's 'total income (adjusted gross income on IRS form 1040EZ) as reported on my federal tax returns for the most recent three years'

My wife doesn't file a 1040EZ as she's self employed, so is she used to use the adjusted gross income from the 1040 income tax form or the gross income from the schedule C profit and loss business?

Another question, Are we suppose to be 125% above the poverty guidlines from the adjusted gross income or is it from the gross income?

Thanks

It should be Gross Income or Line 22 of Form 1040. It should not be AGI or adjusted gross income.

The number they want to see is called "total income" on a 1040 or 1040A, or "adjusted gross income" on a 1040EZ. On a 1040 it would be line 22.

Gross revenues from the schedule C is definitely not the number to use. That number hasn't been adjusted for business expenses, which are substantial for most small business owners and self-employed. Your tax calculations won't be based on that number, and it doesn't accurately reflect how much money you have left to live on.

Ok so I am to use line 22 on the 1040 as the total income. That is much lower than what I actually made last year after all my deductions. So when the uscis asks for 125% above the poverty level are they going to base that number off your total income for the year before deductions or after the deduction?

I was also wondering if my wife and I had to file for food stamps in the beginning of the year because she lost her job( she is now working again) will this be an issue with the affidavit of support or would it be better to get another sponsor?

Thanks
