Husband has been in the states for 10 months now, but he has changed so much, he has now left becuase i saw and email to him stating trying to get his citizenship behind my back for some reason. I guess he went to live with another woman not sure where he went, but if I get a divorce does he go back to his country and do I have to take care of him because of the Affidavit of support I completed with my income. i feel so used what do I do what will happen to me financially do I have to take care of him if I divorce him or does he have to go back. i don't se how they thought he can get his citizenship when he has not been here long enough and he and I are married on my way for a divorce.

From what I've heard, you are responsible for him for 10 years after you get married...which also means that if he gets any kind of assistance (HUD, medicaid, welfare, food stamps, anything), they will come after you to pay for it since you are his support.......

Here 10 months, does he have a green-card and what type? 2 year conditional or a 10 year unconditional card?

Filing for divorce does not get a green-card revoked, once becoming a green-card holder there is not much you can do, other than make out a report to USCIS, and if is a 2 year conditional residency this can complicate things when filing to remove the conditions.

Divorce does not cancel the I-864 affidavit of support either.

how long have you been married? did he get the IR1 or the CR1 visa? if he got the CR1 visa he won't be able to adjust his status

however if he had gotten the IR1 then there is nothing that can be done.

and yes you will still be obligated to the I-864 affidavit. divorce does

not forfeit that. am sorry you are going through this.

From what I've heard, you are responsible for him for 10 years after you get married...which also means that if he gets any kind of assistance (HUD, medicaid, welfare, food stamps, anything), they will come after you to pay for it since you are his support.......

Or for ever.. If green-card holder goes on welfare and never works, or works sometimes then may never reach the 40 quarters of work required to satisfy the I-864.

Five ways out of the I-864.

  1. Sponsor dies.
  2. Immigrant dies.
  3. Immigrant works and is credited with 40 quarters of work per SSA.
  4. Immigrant leaves the USA giving up residency status
  5. Immigrant becomes a US citizen
