Traveling within the US on an expired visa

Hello,

I have a friend that is in the US on an exprired tourist visa. He would like to travel to another state on a plane. He doesnt have a US driver's license. Do you think he will have problems at the airport using his passport that is legal, however it has an expired tourist visa in it?

Do you mean the visa is expired or the I-94?

The visa expiration date is the last time it can be used to enter the U.S. The I-94 expiration is when the troubles start.

I am not telling your friend how to travel and not get caught.

He is illegal and needs to go back home.

What is status?

Does your friend have an adjustment of status application in process? If so then would be safe to travel having a copy of the I-485 NOA-1 letter.

However like K-1 that has expired visa and expired I-94 in passport, can still travel domestically.

Also can use a different government issued photo-id for traveling domestically.

Note I do not believe the TSA is looking for immigrations status, they are only looking for identity of the traveler.

Effective June 21, 2008, adult passengers (18 and over) are required to show a U.S. federal or state-issued photo ID in order to be allowed to go through the checkpoint and onto their flight.

Passengers who do not or cannot present an acceptable ID will have to provide information to the Transportation Security Officer performing Travel Document Checking duties in order to verify their identity. Passengers who are cleared through this process may be subject to additional screening. Passengers whose identity cannot be verified by TSA may not be allowed to enter the screening checkpoint or onto an airplane.

Acceptable IDs include:

• U.S. passport
• U.S. passport card
• DHS "Trusted Traveler" cards (NEXUS, SENTRI, FAST)
• U.S. Military ID (active duty or retired military and their dependents, and DOD civilians)
• Permanent Resident Card
• Border Crossing Card
• DHS-designated enhanced driver's license
• Drivers Licenses or other state photo identity cards issued by Department of Motor Vehicles (or equivalent)
• A Native American Tribal Photo ID
• An airline or airport-issued ID (if issued under a TSA-approved security plan)
• A foreign government-issued passport
• Canadian provincial driver's license or Indian and Northern Affairs Canada (INAC) card
• Transportation Worker Identification Credential (TWIC)

Non-US/Canadian citizens are not required to carry their passports if they have documents issued by the U.S. government such as Permanent Resident Cards. Those who do not should be carrying their passports while visiting the U.S.

The important thing is to have proof of legal status. I have seen reports of those undocumented sic being pulled over.

I would get the passport renewed before using one as ID.

If your friend's I-94 is still valid he can travel by plane eventhough his visa is expired.

If the I-94 is expired, he is out of status, and it is going to be a very risky decision specially if he doesn't have a valid US ID.

If your friend is traveling within the US, it is not necessary to have a visa or to proof any legal status, it is NOT TSA job to report or deport travelers, as long as he show any US government picture ID that matches the tickets name, then your friend is fine

A US visa is only for entry to the US. US visas are meaningless when you are inside the US.
