green card in production? Legal to work?

Hi Everyone!

First of all I need to thank the creators of this site and every one who contributes - I try and help when I can, but I know there are so many people dedicated to helping others in this crazy journey, and I would like to thank all you strangers very very much.

Here's my question: I got the email from USCIS saying that my green card was in production (YES!!) but it's been such a fast timeline that I haven't received my EAD or AP yet. I got a job offer yesterday that I had to turn down because of lack of paper work, but I'm wondering if I can legally work even though I don't have the physical card? Can I accept this contract without the card? It looks like I'm a legal resident, but don't have any proof yet - is that ok? I do have a SSN (with the big ineligible to work stamped on it :S)

I don't know the answer to that but since it is so recent, can you negotiate a start date that's a few weeks out contingent upon receipt of the GC? Did the email state that you'd receive your card within 30 days (or something along those lines)?

Yes - it says it'll come in 30 days. The contract is very time sensitive (for an opera production) - so no leeway. Thanks for responding!

Have you got your SSN yet? If you do then I should think that you can work and just show the GC when it arrives (mine only took 5 days after receiving the email). If you don't have a SSN then you'll have to wait until you get the GC to get the SSN and work.

Bummer! But congrats on getting the GC! (almost!)

And, I'm sure someone around here will know for sure. I would think the problem is that the employer is responsible for seeing the docs within 3 days of hire so without the card in hand, they can't/won't do it.

Congrats! USCIS also ordered production of my card yesterday. No EAD or AP approval. Still can't believe it cuz it only took my case 2 months to get approved.

Maybe try talking to the company. Print the email or notice from the USCIS website and show it to them.

Forget the AP and EAD, Green-card trumps them. EAD and AP are benefits for use while waiting for green-card

Yes once you have the Green-card you will have evidence that you can legally work in the USA.

Typically it will arrive in less than 30 days, more like within a week.

How did you get a SSN??? I was told I couldn't apply for one until I got my green card in....I wanted one so I could open a bank account and stuff....even if I can't work yet......and then I could put my car on the road and get my NYS license...since they won't do that without a SSN either!

OP is K-1. K-1 is allowed to get SSN within the 90 days after entry.

K-1 is allowed SSN for only one reason, to get married. Some states are strict in their interpretation of a federal law requiring those applying for a "license" to show SSN, this causes a problem with persons wanting to get a marriage license without an SSN.

Hi! Thanks for the congrats- I'm so excited. I just went to the local SSN office here in pittsburgh, about 2 weeks after my POE - we were already married too, but I don't know if that did anything, cause I didn't have a certificate yet. I brought in my passport, with the k1 and I94 in it, and she processed it. There was even an issue with the spelling of my name (the officer at the border didn't put a space between my first name and middle initial) but the lady was super nice, and I got the card in 2 weeks. It's very clear on the card that I'm not authorized to work, but it was good enough for health insurance and banking purposes. Good luck!

The Green Card states a "Resident Since" date and that's the date your AOS petition was approved.

So while you haven't received your Green Card yet, you have it in writing that it's being printed right now. I would not hesitate to accept a job and tell 'em that you are a lawful permanent resident. If they ask for your Green Card, tell 'em it's in the mail.

I came in as a K-1 and was told I couldn't get a SSN......we got married anyhow...didn't need it to get married in NYS

You can open a bank account without a SSN, it worked for me.

honestly we share the same SS card for now, i would say you are able to work but employers might wanna see the card just to be sure, on the other hand, you can fill out the form I-9 when they hire you so that shouldn't be aproblem

You can open a bank account without a SSN, it worked for me.

they won't let me....even last year, I had power of attorney over my husband's stuff and they wouldn't add me to his account without a US SSN.....my town sucks lol
