I’m currently in Australia waiting for my KI Petition to be processed (filed on 17 Feb 2011). I’m here for the next 5 weeks and then I plan to travel to the USA for three months to be with my fiancé while we wait. I’m wondering whether I should get my police check and medical done now so I am ready to go when I get back (just in case the petition in approved while I’m out of the country). Is this a good idea or will they be too outdated??

Also, I have lived in NSW and the ACT during the last 5 years. Do I need a police check in both jurisdictions?

The police check is good for a year. Make sure it's the Full Disclosure based off fingerprints. They won't accept any other one. Just go to the local police station and get your fingerprints. (There is a form to fill out for them. It's on the Canberra Embassy website.) You will only need one police check since it's for each 'country'. ACT will just mail it to the NSW police anyway.

The medical is also good for a year. No matter where you are, just make sure you can get your mail, in case they need to mail you the forms or results of your medical. :)

Be aware that you will need to bring proof of your strong ties to Australia (and your NOA from your K-1 petition) with you when you go to the U.S.

You may get a cranky Immigration Officer at your POE who might ask who you're staying with in the U.S. And once your answer, 'my fiance', that's going to raise red flags and he may think you are intending to immigrate on the tourist visa. So you'll need to prove to him that you have intention of getting married on that trip, and that you intend to return to Australia to receive your K-1 visa and then travel to the U.S. and marry at a later date.

You could try and get the police check and medical done before you go but you'll need to call the panel physician for your state (what state are you living in atm?) because some allow you to do the medical without the case number (which you'll get once the petition is approved and file sent to Sydney) and some won't. Some state will have the police check sent straight to the consulate... so if that's the case for your state then I doubt you an do it till Sydney actually gets the file.

You said you're going for three months which is great but you MIGHT get your NOA2 while you're there. If you can't get the medical and police check done before you go it's not a big deal. The medical will take around a week to get, the police check depends on your state but you've just spent 3 months togther so the added waiting time won't hurt you at all.

Remember you have 6 months to use the visa to enter the US, and then you MUST get married in the 90 days after you arrive in order to AOS based on the K1. If you wait longer than 90 days you don't need to leave but you WILL need to file an I-130 which costs $420 (or something like that).. so marry in the 90 days and no need for the I-130 (unless you wait more than 2 years to file.. but that's another story :P).

Emma you can get all that done as Vanessa said .I am pretty sure you said you are in NSW. (sydney) Ring the local police station and make an appointment as if you walk in you could be there for ages. It takes 4 weeks for the report to get back to you as it is sent to Parramatta. As you are not leaving for 5 weeks you can get this done now. As for your medical in Sydney you need to book that in and that could be a waiting of 2 weeks and then you have to go and pick it up yourself. They do not mail from the George ST medical centre. I was lucky my daughter worked across the road and they allowed her to pick it up for me as it was another 1 hour train trip just to pick it up. I signed a letter for her and she just showed ID. The medical and police report are valid for 1 year.Your medical is all done in 1 day blood tests and x rays but you have to go walk about to get them done but its not far and easy to find. If you don't do it now get it done as soon as you get back if you are not approved in the mean time. You just got NOA1 so you could be looking at July for NOA2 so if you get approved while over there mmm you will have to fly home a day or two earlier lol make sure you have exchangeable plane seats. But to be honest I would get it all done now as the police report can be sent to your home and be there when you get back. Dont get it sent to the consulate as it can go missing in mail room. You will send it in with your documents before interview. Hope this helps.
