Hi everyone,

So here's the deal. I have a job that pays 250-300% over the poverty level. I Have my letter of employment, bank statements, W2's and tax transcripts for the last 3 years and all 3 years show my income level is 250-300% over the poverty level. The catch is I'm currently on medical leave and have been for 5 months now. I'm going back to work around the same time she takes her interview so I wont have any updated pay stubs to go with the I-134. I don't even want them to know I'm on medical right now. With all the other proof I have that I can support her should we be worried about the pay stubs? If she fails the interview because of that does she need to retake the entire interview over? or will they embassy just require us to get some current pay stubs and approve the visa at that point?

You should be fine as it is obviously a long term job.

My only worry is if they specifically ask why she doesnt have your pay stubs, she will have to explain that you are on medical leave.

Usually with AOS issues they will issue an embassy equivilant RFE where they will ask you to send in, or return with something specific.

I would suggest she is upfront about the medical, if they ask, and that she has a letter from you explaining the situation that she only shows them if they start to ask questions.

18/11/11: RFE received requesting AOS packet (which had already been sent)

21/11/11: RFE received requesting 2010 tax return

22/11/11: Sent 2010 tax return

29/11/11: CASE COMPLETE!!!

EMBASSY

10/12/11: Medical @ Bentnick Mansions

30/01/12: Interview @ 9am [APPROVED!!]

01/02/12: Passport with visa inside, and medical packet arrive via courier

02/03/12: Flight to Denver!

That's a good idea, It's much better if I explain the situation in a letter "If" they ask about the pay stubs. That would make it easy for her and them! Thanks for the advice! I do have Short term disability pay stubs, I guess I can attach them to the letter. the only issue is they clump several weeks together sometimes so I have everything from a 2 month pay stub to a 1 week pay stub.
