Hello,

I am getting ready to file the N-400 and I just need to make sure I am including what is necessary.

The documents required for the section "Documents referring to you and your spouse" are:

4. Documents referring to you and your spouse:

a. Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or

b. Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years; or

c. An IRS tax return transcript for the last 3 years.

It clearly states OR, so if I send them OUR copies of the tax returns + bank accounts + mortgage + birth certificates of children [we have twins ;-) ], then I DO NOT really need to send the "certified" tax returns, do I?

What do people here think?

Thanks!

David

PD: I actually understand it is not a big deal to ask for those certified copies, but if it says OR.... why sending them?

Tax returns should be sent to show a bonafide marriage "Joint returns"

Notice #4 has Tax returns listed for a, b, and c.

Also I do not see anywhere that the returns need to be "certified"

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

I would send transcripts anyway, no sense having them RFE for them.

Been two years since my wifes' interview, yes, only send in photocopies of all your evidence, but have to bring in the originals for your interview. But there sure weren't any OR's in our evidence, her IO wanted to see everything. Has that changed? Was a bug going on back then about a worthless joint utility bill for evidence, but guess that is over. Seems like the new bug is did you pay all of your traffic violations and parking tickets if any.

Thanks YuAndDan,

Does anybody know how to get the trasncripts?

Call IRS, they are free, they will mail them witin 10 days, or can FAX them to you same day.

http://www.irs.gov/taxtopics/tc156.html?portlet=1 Don't bother with the 4506-T just call the 800 number.

Or can be done online: http://www.irs.gov/individuals/article/0,,id=232168,00.html
