hello everyone

I'm on AOS,my husband filled the I-864 and my sponsor already filled the I-864 too, she is married however, she is not living with her husband long time ago and she is gonna get divorced, so her husband is not part of her household.

my question is: does my sponsor's husband needs to fill the I-864a even though they don't live togehter and will get divorced soon?? with her w2 would be enough to clarify that she does not uses his income???????????//

No I-864A needed.

More than likely they are filing IRS returns as married filing separately. A return is needed to be attached to the I-864 for a joint sponsor.

Is now a US Citizen immigration completed Jan 12, 2012.

hello everyone

Your joint sponsor's husband does not have to file I-864a. However, your joint sponsor has to file I-864 and to check the box 21.© if she is married because she is still currently married and not yet divorced. Your husband has to check 1.(a) and select 8 and select yes. The joint sponsor has to check 1.(d) and select 8 and select yes.
