A guy in my husbands unit (USAF, stationed in Germany) recently got married to a austrian citizen (they married in early February 2011). They both live in Germany now.

I believe they PCS back to the States sometimes this year/summer/fall. Would she be eligible to file DCF in Frankfurt, Germany or would she have to go back to Austria? Would she have to get german residency in order to file from there?

Any tips I could gve her would be greatly appreciated!!!

DCF refers to immediate filing and expedited processing of the I-130 Petition for Alien Relative (Immigrant Visa) DIRECTLY at the U.S. Consulate of the foreign citizen's country.So they could only file from Austria and only from there if her husband is a permanent resident there. They should be eligible for expedited CR-1 filing though, since he works for the military.

And she can't just get German citizenship because she wants to file DFC from Germany, that's absurd.

I wasn't asking about german citizenship but about getting her residency registered in Germany. Sorry for the confusion. Her husband is stationed and living in Germany, he has nothing to do with Austria.

Normally, residency is needed but I believe in the case of military, the embassy can use its discretion. Your friend should contact the embassy, or his local JAG office may be able to help.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
