I have sent my aos this morning with USPS certified return receipt. I hope everything will go right. the packet was huge, I didn't wanna take any chances and I have gone over everything many times. I will be really surprised if something is missing. anyway , wish me luck

you can only check again and again but if something wants go wrong they most likely will, lol, like for example, on 485 I wrote my mom's last name instead of name lol, but i doubt i will get an RFE for this silly mistake. Anywho Bol şans

Ha! I just called USCIS to ask if an appointment has been scheduled for my biometrics yet... Well, pretty much she said nothing has been specified to show that a biometrics appointment has been scheduled and wait until 30 days after receipt of the receipt number for the biometrics appointment letter. . Pretty much she was repeating only what was on my USCIS account...

I just checked my case status at the USCIS website, and it says "Request for Evidence." :(

On March 28, 2011, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail.

What does this mean? I've been straining myself trying to think of what we could possibly have forgotten, but I can't think of anything at all!

Married since 03/02/2011, AOS from F-1 visa, green card granted 05/24/2011.
Blessed with a healthy baby boy, 08/19/2011! We get to keep our family together! Thank you! smile.png

It could be anything from a missing signature to a missing form.. I know it is hard, but try not to drive yourself crazy until the actual hard copy RFE comes in the mail. There is nothing you can do before that. If you made a full exact copy of the package before you sent it out, you could go through it and see if you can easily figure out what was missing.

Other than that, all you can do is wait and see what the RFE says when it comes in the mail. It's not the end of the world - it will delay the overall process a bit, but hopefully not too much.

on which application did you see this? which receipt number, i mean is it for your 1-485, 765 or 130? It means that either you wait for the letter requesting for an RFE, maybe something is lacking in your documents/tation or there is an error in your form, or if calling USCIS would help to know right away what is missing or lacking in your application, these are the only ways to find out and to prepare beforehand so that you can send the right one, right away.

It's the I-485. I don't have an exact copy of the package, because the only copy place in town charged like $1 per copy and it cost over $150 just putting the package together. We couldn't afford to do it again. Plus my father in law is very private, and had his I-864 sealed in its own envelope. I just pray it wasn't anything we need to send out extra for (forms from the IRS, or other copies from Norway). I'm also worried that the fact I'm adopted from Korea complicated things.

Stupid kid needs to grow slower. I would be a lot less stressed about this if the threat of ending up with a multi-thousand dollar hospital bill wasn't hanging over my head. :(

I'm also concerned since I read about others whose visa have expired, who are advised not to leave the country while going through the AOS process, even with an AP, because the overstay means it will be a ban. I have to leave this summer after my visa's expired and I'm afraid I won't get back then, even with an AP. :(

How long does an overstay have to be, before a ban comes into effect?

If I don't get my interview in time, I'd have to reschedule it for October sometime. Then I'd leave with AP in hand at about 90 days overstay on my F-1 visa (it expires in May). I'd come back with baby in tow about 150-170 days after my visa expired. Would I incur a ban? Could I come back? This is frustrating the ####### out of me.

Don't worry mine took 16 days.. i sent it the 8th of march and i finally got the text message and email the 26th So just wait.. they said u should wait minimum of a month before they can even do something for you.

first let me say, sorry for the RFE on your case, in most cases if it's an easy thing, you'll just send it back and don't lose more than a week.

not sure about this whole ban things but, if I were you i wouldn't risk it, if you are an overstay F1 and even if you had the AP, i don't know i wouldn't travel, i mean I understand you wanna go back for the hospital purposes but you know this is serious.

LlamaInvasion, I actually don't think you would occur any out of status -days here. Once you filed your AOS, you effectively stopped being an F1 student - you are now "AOS pending". It's a bit of a complicated matter it seems, no one really seems to know what our status is once we have filed the AOS. But, what i do know is that we are not really under the F1 status anymore, which would make me think that we can't overstay our I-94s anymore either (And someone please correct me if I am wrong)

I am in the same boat - I'm supposed to have a wedding in Finland end of July. I doubt I would be lucky enough to have had my interview by then - in all likelihood it will be scheduled for July when I am supposed to be in Finland. I don't mind re-scheduling it as long as I have my EAD in hand, but I am also trying to find out if leaving will be a problem.

However, I am pretty sure it shouldn't be. At some point I will try my luck calling USCIS about this, thought I doubt they will really know. My international students office is super helpful and professional, so I am going to ask them too. I also consulted a lawyer early on in our process via email, and she doesn't charge for that, so I might email her too.

And - just as a side note - if you plan to return to the US with an infant, you two should really consider a good insurance policy :( I know they are expensive, and I think the maternal health care system in this country is absolutely terrible and a disgrace, but it is what it is, and not having insurance will most likely end up costing you guys more. Sorry if it seems like I'm preaching, I don't mean to do that.. but a friend of mine just got a $10,000 bill from a mid wife, and they had a HOME DELIVERY. Ridiculous. They also don't have proper insurance, and it kills me to see them in their current situation. It sucks.

Good luck with the RFE, hopefully it won't be anything big. If I find out anything new about this overstay matter, I will let you know.
