Hello To All

I find this site to be very interesting and informative.

I just got married in december last year after a a long distance relationship of 3 years. I am about to file I-130 petitions for my wife and her daughter. My step daughter has her father's last name and my wife has to prove that there is no custodial battle between her and the child's father, which there is none.

The father has consented to give full custody of the child to the mother and allow the child to migrate with the mother as long as all goes well.

What i want to find out is if a document from the father notarized by the registar of the court in her homeland barbados would be enough proof and accepted by the USCIS and the interviewing office when she is interviewed. If not can someone please direct us as to what will be accepted.

I can't help you with the child aspect of your question but I can tell you there is no more K-3 visa. Although it will be accepted and processed by USICIS, the I-129F which leads to the K3 visa, will be closed by NVC

The proof will be required by the embassy. I suggest you check with the embassy to make sure of exactly what they will require. The embassy I am familer with gives out a form letter that they ask to be used as a guide. The dont mention that the letter, which is in English must be translated to the native language but that is in fact the requirement by the embassy.

show your divorce papers, a court other that gives you permission to take your daugther out of the country, from your ex,how old is she did you marry before she is 18 then if so she comes on your 1-130 cr-1 togather and gets permanent resident card. and social security card.if she is over 18 then thats another file and wait,

You need a country specific answer but any custody or permission issues are dealt with at the visa interview. Court order of full custody works in only some countries. The appropriate parental permission documentation for the applicable country works every time.

Facts are cheap...knowing how to use them is precious...
