Hello,

We are filling out all the required forms for AOS and we are getting confused: who needs to be filling out the forms and writing the cover letter: the US citizen or the alien spouse?

The US citizen is the one petitioning for the AOS for the benefit of the alien spouse or can the alien spouse apply him/herself for AOS?

I am the Alien spouse and I signed all the forms and the cover letter but I started to wonder if it should not be my husband signing the cover letter (applying for me) and signing the forms.... actually my question is more about the cover letter as I think I am the applicant in Form I-485, EAD and AP petitions?

Thanks for your help.

You are the one that is Adjusting Status not your husband so you are the one to be filing out the forms and signing except form I-864 Affidavit of Support he will sign. You will also be the only one that can contact USCIS about your applications (just so you know).

AOS:

Green Card APPROVAL for wife and stepson 02/10/2011

Revd'd Green Cards for wife and stepson today 02/19/2011

My timeline gives all the information

The USC is NOT petitioning your AOS. The USC is your SPONSOR that is it and so he completes the I-864 and attends the interview with you (if you have one) attesting to your good faith marriage. YOU are applying to adjust YOUR status from K1 to LPR.

So your USC is irrelevant to the process except to sign the I-864 and go to the interview. This is YOUR process, not the USC's.

Thanks a lot for your quick answers!

I sent my AOS package this morning. Fingers crossed now!
