F1 student Urgent help with EAD, OPT or AOS ? need EAD ASAP

I've just noticed that same thread. Maybe they don't need to be notarized.. We consulted an immigration lawyer earlier (via email, which she did not charge for) and she advised us to notarize the copy of the marriage certificate. But it looks like that is not actually required.. so I guess just a photo copy is fine for the application.

Affidavits from third parties need to be notarized, correct?

Yes,affidavits are highly recommended to get Notarized. We are having our mutual friends write affidavits and get it notarized at a bank where we are members.

We did not notarize our affidavits either. Nothing needs to be notarized. :)

There is some discussion that the word affidavit itself implies something notarized, so my friend wrote us an "attestation" instead (her father is a lawyer). We did not notarize it. We just sent the original of that, because that form was made explicitly for USCIS, whereas marriage cert etc is not made explicitly for USCIS, so only photocopy is needed. Hope that helps.

Mrs. Finland, what did you write on I-130 where they ask "Date authorized stay expired, or will expire, as shown on Form I-94 or I-95?" Mine says "D/S",do I write the date that is on my I-20 by when I am supposed to finish my school ?

I wrote the expiration date of my F-1 visa. Some people have apparently left it blank. D/S means duration of stay, but unless you fill out the form by hand, you can't put text into the box, it has to be a date.

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

For Affidavit of Support, I-864; What if the petitioner (my wife to be) and principal immigrant(myself) have joint account together. Where do we write that ? The form asks for account balances separately

If you make enough money to sponsor without any assets, you don't need to put anything about a bank account. If you choose to put a bank account, a joint one is fine... I am not sure where you read that is must be separate (an intending immigrant spouse can add their income and assets to the I-864, so there may be separate boxes for it, but you could just put your joint bank account there... once). From your other posts though, it sounds like you guys just qualify without the bank account/assets, so no need to put them. Good luck.

We are filling out I-864EZ. Turns out the form is also easier to fill ;)

I-765 question: I had EAD through OPT from my bachelor's days. When I now apply for I-765 with the AOS package which box do I check mark ?

"I am applying for:

Permission to accept employment

or

Renewal of my permission to accept employment?"

Permission to accept - code C9.

It's a new category, so new qualification etc. There is another spot to tell them about the other EAD.

So, when did guys actually receive the Work EAD card physically, I can see from your time line the day you guys got approved for it.

Thanks for the info. I have decided to go the AOS route for my EAD. I have SSN. So much paperwork and preparation.

I live w/ my fiancée and (wife soon to be). However, we will be getting a new place in 2 months. I do not want my EAD card and AOS to get lost in the mail.

Therefore, I have put in the address box of I-765 "C/O street address." Then, City, State and Zip.

What about on AOS ? Do I leave the address box blank and just fill inside C/O ?

I am not sure if using your friend's address is okay, sorry!

There is a address change system in place for this very reason, but it is not perfect, and I can understand your hesitation. Hopefully someone who knows for sure whether a C/O address is okay will respond.

I have been advised to get a PO BOX. With that advise comes another headache if USCIS accepts PO BOX or not. After talking to one of the USCIS customer rep, he said PO BOX is fine and that's where things will be mailed.

My question to you is: Who gets notified for I-130 (petitioner or beneficiary), or is there no separate notification if I-130 has been applied along w/ I-485 and I-765? I think the USCIS guy said that the petitioner has to put their residential address on I-130 and beneficiary can put PO BOX (aka Mailing). Even though we'll be living together, I would want to know under whose name do they mail any notifications regarding I-130 ? All this because, we will move in 2 months time, and don't want to lose any notifications etc
