confusing questions on I-864, please help!

Hi gusy,

I have another question to ask you guys, please.

we have a joint sponsor, and when he filled in I-84 form on Question 21-c, He entered "1" because he's married. and He and his wife filed the 2009 tax together. I wonder if his wife need to fill out any form to submit together?

another question is that question 21-f, he entered "3". But he only filled out his wife info on question 24-b.

Question 24-e: Should I check this box? The question of "The person listed above", does it mean me or the person on Question 24-b?

please help me with those questions.

It's not clear whether your joint sponsor is combining his income with his wife's income to qualify as a sponsor. From the info you provide, it sounds like he is.

If this is the case, his wife needs to fill out an I-864A which will be submitted with the joint sponsor's I-864.

Question 21-f: is he sponsoring/has he sponsored other immigrants? If so, he is correct to be including them there, and they do count as part of his household.

Question 24-b: unrelated to question 21-f. Like I said, if he's combining his income with his wife's income to qualify, then he's right to list her there.

Question 24-e: it refers to the person listed on 24-b, so it's the wife, not you. The box should not be ticked.

All that said, if your joint sponsor qualifies with his own income and meets the poverty guideline requirements by himself, he is NOT required to combine his income with his wife's on the I-864 just because they file taxes jointly. His latest W-2 confirming his earnings should be sufficient proof of his income and his wife's input is not needed.

To the OP, your USC spouse should file I-864 and select 1.(A), select 8. and select YES, select 21.(A) and put 01 and DO NOT put on 21.© on the I-864.

If the joint sponsor lives with your on the same household, the qualified joint sponsor only needs to file I-864a.

If the joint sponsor lives on different address then follow below:

Exactly, if the joint sponsor qualifies on his own income, the joint sponsor only need to file the I-864. The joint sponsor would select 1.(D) and select 8 and select YES, select 21.(A) and put 01 and select 21.© and put 01 on the I-864.

If the joint sponsor does not qualify on his own income and combine his income with his wife, then the joint sponsor has to fill out the I-864 and his wife files I-864a. The joint sponsor would select 1.(D) and select 8. and select YES, select 21.(A) and put 01 and select 21.© and put 01 on the I-864.
