Aircrew Arrested, will I get a Visa

Hi all!!

I wonder if you can asssist.

9 years ago me and some friends, went to the river and went out on a canoe, that didn't belong to us, we were aged 18, upon returning the canoe some 25 minutes later the police swiftly arrested us for Taking without consent, which falls into the category of Larcency.

On the DS160 application form it clearly asks. "Have you ever been arrested?"

If I put yes, and fill in the blanks with the specifics of the incident, am I likely to be refused a Visa? I have accepted a job offer and it will mean I need this Visa in order to work!! No Visa.... NO Job!!

The offence no longer shows on basic CRB checks, however the arrest will remain on the Police National Computer for life.

What are your thoughts!?

I am worried sick about this, and seriously don't know what to do!

Generally, in order to be considered a crime involving moral turpitude, the larceny would have to be with the intent of keeping what you stole. It sounds like you didn't intend to keep it, since you returned it after your joyride.

Answer the questions honestly, and provide the required court documents. I doubt they'll find you inadmissible for this.

well how many years ago did this happen, and what was the penalty for the crime (did u do time)

maybe you can get a waiver for it or something, while i do not have specific answers for this

particular crime, i do know that it is not wise to lie, you do not want anything coming back

to haunt you. so be truthful and be specific so that they may understand the full nature of

the situation. and try to look into a waiver.

maybe someone more experienced can give you a definite answer

it was 9 years ago! I was cautioned which stays on file for 5 years, however the fact I was arrested stays on the Police National Computer for life!! I did not attend court, nor do time!

Doesn't matter if you never went to court or jail, or how long ago it was. The question is asking if you were ever arrested, to which you MUST answer yes. Lying is misrepresentation which can have you slapped with a ban from the U.S.

Make sure you provide all documents pertaining to the arrest.

This question is really simple, you were arrested so put yet. You say 'no visa no job' but misrepresentation carries a ban so if they catch you (and they probably will) would you be working in the US the?

Answer honestly on the form and when questioned. I think you'll be fine, as Jim said, it wasn't for the purpose of possession

Thanks for the information people!

Heres what I am going to do.

I will be completing the form with honesty and accuracy

I will contact my local police station and obtain the record for my arrest.

I will obtain a criminal record check

and take it all with me as supporting documentation to my case!

I just hope they provide me with the Visa, I hold a current airport ID which was obtained only because my record is now clean.

Are you USA that strict on things you did stupidly as a youngster.?

Slow down, you're potentially wasting your money. From the terminology you're using, you're in the UK, correct?

If this is the case, then you'll need to do the following:

Say YES, you've been arrested. It's the truth and they will find out.

Found out which police certificate the US embassy wants, there are several types. Do this by contacting the Embassy and asking them.

For immigration visas applied for from within the UK, you need an ACPO certificate. These come back with either No Trace, No Live Trace or a list of your convictions, if they're still live. You should get a certificate back with No Live Trace on it.

The next step will be to get a 'Subject Access' check done. Not sure how to go about this, but google it and you should get an answer. Takes about 40 days for it to come through, if I remember correctly. This is a history of all recorded arrests.

You should at the same time be getting whatever paperwork together you can about the arrest itself.

Don't panic about it, there are several people who have moved to the US from the UK who had minor offenses in their past for which they only received cautions.

Don't think that the US is the only country who's this fussy about it. We're pretty tough on it too (if you're in the UK)...

p.s. What did you reply when you answered the question on your job application form? Could this cause problems with your prospective employer? It's going to take a little while to get the paperwork you'll need, and they might have problems holding the post open for you to get yourself sorted out.

Are you kidding me? No I do not agree with that at all. Why would Air Crew be different to anyone else? People get arrested for stupid things, like driving without a valid MOT or unpaid speeding tickets. I really don't think anyone should be denied a visa for that.
