Facts:

Canadian Citizen - CR1 Visa.

Worked in Canada Jan-Apr 2010.

Immigrated to USA May 2010.

Received Canada EI Oct 2010 (withheld 25%) Just one payment

Worked in US Nov-Dec 2010.

Husband owes IRS money.

Service Canada logged me as departed on May 1, 2010. They did this for me over the phone.

So, I've read through this forum and I don't really understand.

Can I file my Canadian T4 with the CRA and my US W2 with the IRS and leave it at that.

Since hubby owes taxes is there anyway I can keep MY refund, if for example I file married filing separately?

and.

I have a daughter, my husband is not the bio-father, and has not legally adopted her.

Can he claim her as dependent? (For future years, this year I will claim her).

The last thing I want is the CRA or IRS to come knocking on my door a year from now looking for money! LOL

Please help! Cheers!

Oh and btw I'm not a newbie. I had an account on here, but it was logged with my old work email so I can't access it now.

I have to update all the timeline info and stuff again.

No if you have canadian income it must be stated so on the US tax return. Then you file the foreign income credit and they do not tax your canadian income.

What about the Canadian CRA? Do I have to file taxes with them to? Yes. Because they want the taxes from Jan to Apr, Correct?

If you worked before you left you need to file a final return with canada yes. There is a spot to list the date you left/became PR of the US. That tells them you will no longer be filing canadian returns.

Ok so file my Canadian taxes as I normally would, and check off the box regarding leaving Canada and becoming a US PR.

Then, file US taxes, stating Canadian income and completing form for a foreign income credit.

Since my husband owes the IRS, and I have a "complicated" first US return, I want to file married, but separate - do you think this is the most advantageous?

Thanks for all your help. I'm nervous about messing up with the IRS. I've heard horror stories. I'm also trying to avoid paying the $700 I was quoted for

a tax return. ARGH!
