U Visa

I am counselor at a High School and I have a student that has recently been given a U Visa. I have read a little about this VISA but I could not find out the answer about student financial aid. Can she apply for financial aid while she is on a U VISA? She is a senior in High School and is trying to figure out if she can be eligible for any government aid. She is very smart and I am trying to help her get into college.

From what I read on financial aid website, here is the list of those who are eligible for it

You must be one of the following to receive federal student aid:

•U.S. citizen •U.S. national (includes natives of American Samoa or Swain’s Island) •U.S. permanent resident who has an I-151, I-551, or I-551C (Permanent Resident Card)

If you’re not in one of these categories, you must have an Arrival-Departure Record (I-94) from U.S. Citizenship and Immigration Services (USCIS) showing one of the following designations:

•"Refugee" •"Asylum Granted" •"Cuban-Haitian Entrant, Status Pending" •"Conditional Entrant" (valid only if issued before April 1, 1980) •"Victims of human trafficking, T-visa" (T-2, T-3, or T-4, etc.) holder •"Parolee" (You must be paroled into the United States for at least one year and you must be able to provide evidence from the USCIS that you are in the United States for other than a temporary purpose and that you intend to become a U.S. citizen or permanent resident.)

But since she's an international student, she can apply for some financial aid but its from other resources, not from government. It's not too much either. Here is the link http://www.edupass.org/finaid/ Always remember to check with the school she wants to go to

Thanks for the information!! I will check out the link that you posted. The U Visa seems to be similar to the T Visa but for some reason is not listed on the Fafsa website. Thanks again!!

General Information:

The purpose of the U visa is give victims of certain crimes temporary legal status and work eligibility in the United States for up to 4 years. The U visa is a nonimmigrant visa and only 10,000 U visas may be issued every fiscal year. Family members may also be included on the petition including spouses, children, unmarried sisters and brothers under 18, mothers, fathers, as well as stepparents and adoptive parents. An approved U visa petition will automatically grant the applicant work eligibility in the United States. An Employment Authorization Document will be included with all approved petitions, which can be shown to any employer to obtain a Social Security Number to start work legally. Currently all U visa applications are filed at the Vermont Service Center.
