from K1 to AOS, you get a 2 or 10 yr greencard?

Correction: two years if the AOS process takes less time than that.

2005/07/10 I-129F filed for Pras

2005/11/07 I-129F approved, forwarded to NVC--to Chennai Consulate 2005/11/14

2005/12/02 Packet-3 received from Chennai

2005/12/21 Visa Interview Date

2006/04/04 Pras' entry into US at DTW

2006/04/15 Church Wedding at Novi (Detroit suburb), MI

2006/05/01 AOS Packet (I-485/I-131/I-765) filed at Chicago

2006/08/23 AP and EAD approved. Two down, 1.5 to go

2006/10/13 Pras' I-485 interview--APPROVED!

2006/10/27 Pras' conditional GC arrives -- .5 to go (2 yrs to Conditions Removal)

2008/07/21 I-751 (conditions removal) filed

2008/08/22 I-751 biometrics completed

2009/06/18 I-751 approved

2009/07/03 10-year GC received; last 0.5 done!

2009/07/23 Pras files N-400

2009/11/16 My 46TH birthday, Pras N-400 approved

2010/03/18 Pras' swear-in

Two years if married less than two years

Actually always a two year card even if married longer than two years when AOS is approved, this is because K1 AOS results in a conditional status.

Now if for some reason you take time and adjust status and looks like it will be at two years om marriage, then attach an I-130 to the application and base AOS on the I-130, this will result in an unconditional 10 year card.

The latter is in cases where delay was for something out of control. The downside I will list.

  1. costs more, fee for I-130 and full medical.
  2. results in an interview asking why the delay
  3. K1 cannot work during the delay until AOS is filed and getting EAD
  4. Cannot travel without AP which if filed prior to AOS will have a fee.

No. The same length of marriage rules apply.

If you enter the US on an CR-1 visa and at that time you have been married less than 2 years you'll get a 2 year card. If you enter after more than 2 year of marriage then 10 years.

For K1, if the AOS is approved and you've been married less than 2 years then 2 year card. If you've been married more than 2 years you should file an I-130 in order to get the 10 year card as the K1 has a proviso that a 2 year conditional card MUST come first.

IR-1 gets a green-card because an IR-1 is the visa issued to an immigrant who has been married more than 2 years prior to visa interview.

CR-1 means "Conditional Resident" it gets a 2 year green-card if it is used to enter the USA prior to 2 years of marriage, however if it is used to enter the USA after 2 years of marriage and provide evidence to POE of 2 years of marriage, the resulting green-card should be 10 year card. Visa is coded CR-1 if interview happens prior to to years of marriage.
