Change passport from ex-married name to maiden

Hi,

I am new and am glad to have found this website. There is such a wealth of information that I feel confident I can apply for a K-1 visa on my own behalf without paying and expensive lawyer.

Here's my situation-- I was married (divorced 3 years) but my current US passport has my former married name. I've met someone and dated for the past 1.5 years and would like to get married, however, I used my passport (former married name) to travel back and forth to see my fiancee over the past few months.

I was wondering if before applying for a K1 visa, should I get a new passport that reflects my maiden name or just keep the one that has my former married name? My personal information such as driver's license, credit card, bank statements, etc are in my maiden name. I just never changed my passport.

Filing based on 3yrs/USC Spouse. 3 year residency anniversary is in August 2014. Filed immediately after the 90-day early filing mark (May 2014)

09/15/2014 - Inline for interview scheduling (was stuck in "Initial Review" for over 3 months!)

Well, what is your "legal" name right now? That is the one you will have to go with.

Change your passport name after you marry to the fiance's name . Or if you want to keep you maiden name forever and a day then change it to that. But if you marry this guy then you will take his name yes? SO you will have to change drivers license the lot anyways so then you can do your passport. I am just doing this now too as my passport is in my previous married name. Now I am changing it to my new married name.

He had no issue that I traveled to see him on a passport that had my former married name.
