fiancè visa

Hi, I am Italian and my fiancè is American. We decided to get married and I am in Italy in order to get the fiancè visa. I spent 3 months in California with my fiancè and I wanted to attend an English class there so that we did all the paperwork for the Student Visa. We didn't know anyhting about Visas and stuff. When I had my interview at the Consolate in Naples (Italy) my student visa was denied because my American boyfriend (at that time we didn't want to get married yet) sponsorized me. At the Consolate I was told that my Visa was denied because of lack of strong ties with my country. After about 2 months we decided to get married because we realized that we really want to be together and that we miss each other so much. My question is: if I was denied the student visa 2 months ago, will I get in trouble when I have the interview at the Consolate for the fiancè visa? I will tell them that at that time we were not sure about getting married and that I really wanted to go there to attend an English class, because I wanted to realize how my life could be in USA, living there for real, I mean, having something to do and not being simply a tourist like I was for 88 days the first time. That was the reason why I wanted to go there to study! So that I would have had the chance to live there having something to do! With the visa waiver program I had no chance to study and to do anything there only being at home and going to the gym! Thanks a lot

It shouldn't be a problem: many pepople are in a similar situation: my fiances visa tourist visa was denied for the same reasons, but should not affect your fiance visa. Good luck

; It shouldn't affect your application since a K1 Visa is a totally different Visa than a Student Visa.

A Fianc(e)e Visa is part of Immigration, you don't have to show strong ties when entering the US with K1 Visa in hand, since it's a ONE-ENTRY Visa.

A Student Visa has, ofcourse, nothing to do with Immigration. However, you have to prove strong ties for them to know for sure you won't stay in the US.

Anywho, like I said, it won't effect your Case at all. All you couldn't prove was strong ties, and it wasn't about a serious crime or whatever, now that would be a different ball game. Don't worry and enjoy the bumpy ride!! :thumbs:

February 22nd, 2012: Green card in production
February 27th, 2012: GREEN CARD in hand, yaaay!!!




November 10th, 2013: ROC
