Hello all! My fiance' is British and will be going to the embassy in London [when that day comes!]. I was reading that I'll either need to send him a notarized I-134 or an I-864. Does anyone know which one they will most likely require, or is it a random thing?

Also, I am not actually employed, I'm intending to list my assets of $300,000+ and my interest income as proof of support. Will I need to start saving my monthly statements, and will that be enough proof? Should I hire an accountant for help?

Any feedback is, as always, greatly appreciated by this newbie [should be sending the I-129F off tomorrow or Saturday!]. And, as always, good luck to all who are filing, waiting, or approved :)

From within those instructions........

This requirement does not apply to fiancé(e), Kii or V visa applicants when applying for a fiancé(e), Kii or V visa.

The I-134 is used for the K visas (London) when it is requested to ascertain if the applicant will or wont become a public charge.

Carole, its funny you mention that - john_and_marlene and I were having this discussion in another thread.

http://www.visajourney.com/forums/index.ph...=29245&st=0

His understanding was that I 864's couldn't be used for K1s, but I remembered hearing stories like yours before.

Thanks for the info!!

TheZilla, it's not much of a minefield, but I do recommend again that you start completing one now; you will need it eventually and you do have a somewhat unusual case.

I just got packet 3 from the Paris Embassy and they ask for I-864 !!!

carole, have you checked past K-1s from Paris to see if that is what they were *really* required to provide at the interview?

I wonder if that isn't just their standard IV packet three?

You are welcome TracyTN. Each Embassy has its specificity... The Paris one has contradicting info on its website vs sent documents, and is very had to contact... But "c'est la vie"

It is written "I-864" 2 times, no mention of I-134 on DS-2001 checklist of packet 3. But I do not see a very strong difference between the 2 excepted the binding system... Sorry too complicated for a frog brain!

Note - 300,000 USD in assets should be more than needed for the affidavit - good for you!

caroledfb,

What you are reporting is not consistent with what's posted here http://www.visajourney.com/consulates/inde...e&cty=Paris

Of course, what's posted on VJ is not always correct. Then again, consulates have been known to send out visa application packets with the wrong forms from time to time.

Yep, you're absolutely right. I had heard of consulates requiring the I 864, but my crusty memory couldn't remember if those were for K1s or not.

You'll have to be sure and let us know how it goes at the interview and if they change their minds and have you use the I 134 instead!

caroledfb,

I doubt it. I especially doubt that a change would be made that goes against the guidance of the FAM, which is based on the INA. I suspect that you got an incorrect form in your packet. (The IV unit processes the K non-immigrant visas, which can lead to all kinds of confusion.) But do let us know when you find out.
