Hello Everyone,

My husband is a VWP overstay from a 2003 entry. We are going through AOS based on our marriage, with 130 and 485 pending. We were just granted a EAD, which is currently in production. He does not have an I-94, as it was rumored "in the community" a few years back that it was best to remove it from the passport and toss it.

Anyhow, we have the EAD (well, soon), but now want to get the SSN. Can we just go in to the SSA with our EAD and a Passport as ID and be good to go? I've dug through the SSA site as well as some other forums, but can't quite nail down the answer. My concerns stem from whether, with the overstay and the lack of the I-94, we can still use the "Legal Alien Allowed to Work" box on the application based on the EAD.

Anyone with any insight or a similar/same experience?

The EAD is work authorization from DHS. He should be able to get an SSN with an EAD card.

I see the problem, it says "legal alien allowed to work"

It's my understanding that while the AOS application is being processed, you are temporarily legal.

Someone who knows more about this needs to reply, but my gut tells me that he should be able to do this.

How's the application going? Which field office is dealing with your application? When did you apply?

Your fellow overstayers are eager to know :D

So far, so good in a "no news is good news" way? We applied 12/22. Biometrics done 1/19. Online notice that EAD was processing was 2/18, but no email/text on it. Hanging tight for an interview date. No RFEs, but a very, very thorough completion of all docs.

Not sure about the field office? Filed to Chicago lockbox, MSC prefixes to our receipts, but anticipated interview in the NYC office (good thing re: overstay, I hear).

Yes, as Jim said, the EAD is work authorization, and is sufficient to qualify for a SSN.

And yes, once the package is accepted for review, the alien begins a new period of authorized stay. If you want to think of it as "temporarily legal" that's fine :) If the AOS is denied, then that authorized stay ends. Hopefully it's approved and that's that. Good luck.

We're both in NY, but I'm in the Long Island area.

It would be great if you decide to stick around and do a timeline, we'd love to keep track of your progress :)

05/13/2011 (Day 65) EAD received in the mail
05/14/2011 (Day 66) Email confirming EAD approved (Case updated online TOUCH)
05/20/2011 (Day 72) SSN In the Mail.

09/08/2011 (Day 200 ) Email notification of Interview.
10/11/2011 Interview at 26 Federal Plaza, NY!
Interviewed and Am expecting RFEs!
10/13/2011 (Day ***) Received RFE-- Requesting that I provide documentation to prove I was never married in Uk or Illin
02/11/2012 (Day ***) Service request..Told its being reviewed by supervisor

24th March 2012!!!!!!!!!!! Email notifiying me of CARD IN PRODUCTION
03/26/2012 (Day 376) Emails confirming that my I-130 and I-485 have been approved.

4/2/2012 Green Card In Hand!

Unbelievable that my journey took this long but Im thankful

Next Stop Premed...Yup!

3/24/2014 Application for conditions to be removed

9/22/2014 APPROVED without interview.

Myopia/doctorbeat, I will check in with status updates as they come along, probably a good comparison for the both of you. He's Irish, so not UK, but close (he'd disagree...)! I'm a USC.

Thanks for everyone's help! Went by the SSA office this morning with the passport and EAD. Piece of cake. SSN should arrive in 10-14 Days!
