Hi My father is a US citizen I have been waiting for my approval for almost 5 years and have finally recieved it. I am now waiting for an Intereview, it seemed to be taking quite a long time so I called and asked what the issue was they have told me they have regressed back to Jan 2005 when they were on Feb 2006 last December.. I am May 2006. This is crazy my father is US citizen.. What can I do? What is this form I-485 can I fill this out or do I need to have some kind of visa for this. Any advice would be most appreciated.

Nothing you can do - if the immigrant visa number is not available, you don't get the immigrant visa. Hope the visa bulletin shows your category back to 2006 soon.

Welcome to VJ

Sorry but saying your Father/Dad is a US Citizen is Irrelevant because you are subjected to the Retrogression... You are indeed subjected to the visa Bulletin's Cut off Dates. There is NOTHING that you are able to do sorry. The I-485 form is used for those persons who are in the USA and will adjust from a legal status to a Permanent Resident. You will wait for your priority date to become current so that you can have some kind of visa to solve this.

I-485 is for adjustment of status, is used when a NON-Immigrant adjusts status in the USA, and can only be used based on a petition that results in a visa number being immediately available, it wont help you in anyway.

I-485 typically is used when a K-1 fiancee enters the USA, marries and then adjust status based on the K-1.

A little more waiting will be needed.
