LETTER OF INTENT

Hey guys..

So i was again going through my stacks of papers that I sent to

file my petition.I notices that both letter of intent to get married once in US are

still in my damn folder...argghhhhhhhhhhhh :bonk: :bonk: :bonk:

Now here's my question..

If I do get an RFE and they actually ask for those letters that I mistakenly forgot to send

could i send those exact letters or do I need new ones with a fresh date of RFE? :( :(

Please help me as I am half way into the waiting time.lol

Should i be expecting an RFE?

Any answer and help would be appreciate it.

i i dont know but my fiance hired someone to prepare our package and we did not include letter of intent too.thats why im woried too bcoz of that. hope we didnt get rfe.my fiance has a relative who are approved already without letter of intent to marry on their package.we'll just see and wait.

I don't know how valuable it is but I'd say be proactive and not reactive. Do not wait until you get an RFE. You should call USCIS and explain, let them tell you what to do. You might be able to send the letter to them with a copy of your NOA 1 as an addendum.

Since it is likely that your petition will not be adjudicated still for about 2 more months, you could have your fiace send you freshly signed copy of the letter of intent. You could be prepared for when you receive the RFE. However, other VJ members have said that their petitions have been approved despite their lack of letter of intent so it would depend on the judgment of the particular adjudicator. I do not think you could send the letters to "join" your original packet and petition without a RFE, but let us know if you are successful. Best wishes! (F)

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I don't work for USCIS- but I don't think you would get an RFE if you were missing the letter, as long as you demonstrate you are in a relationship and have an intent to marry (pictures, letters, both submitting the supporting docs for application, etc.). So, try not to stress about it! Nobody can be "perfect", we don't even know what a perfect packet would be, everyone does something different. And most people say they worried too much about something out of their control!

I know it sounds nuts.. but spend your time shopping for wedding dresses, and let your packet do its thing. :)

12-04-09 mailed I-129F

12-07-09 I-129F arrived in Vermont

12-08-09 NOA1

12-10-09 check cashed

04-05-10 NOA2 (no touches until approval!)

04-19-10 received at NVC

04-21-10 NVC sent to embassy

embassy asks us for ridiculous things before giving interview date, such as a photocopy of the sealed envelope from the medical exam...

I wouldn't go crazy about it. Cases have been approved without it. In actuality its really up to the USCIS Agent reviewing your case...they all judge things case-by-case. If you have enough "legit" evidence establishing a real relationship, then the letter probably will not matter as much. But if you are missing a lot of things, then it may be a problem.

Si, man. Also, receiving an RFE is a golden opportunity to send even more (more recent) evidence of bona fide relationship, along with what the RFE asks for.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

When I sent my form in back in September, I just JUST the I-129F and the fee. I didn't understand the directions and my 'packet' was severely lacking. There is NO way they would have approved my petition without proof of citizenship, proof of having met, etc.

So when I realized this in January, everyone on VJ said to wait for the RFE. USCIS even told me this. However, I was so stressed I was going to be denied, that I made copies of my entire packet, and I mailed that to my Service Center with a copy of my NoA1 on top.

Then, I got notice my case was updated. I was approved. I know they matched my paperwork up with my petition because there is no way humanly possible to have approved me based on just the one single form.

So my suggestion is make a copy, and mail it in to your service center with a copy of your NoA1 on top. Worst case scenario is they don't match it up, and you get an RFE for the letters. You're also out the postage price. Best case scenario is that they match it up with your petition like they did for mine, and your case does not get an RFE for those letters.

That's just my experience. It's worth a shot if you ask me. Being proactive about my missing paperwork is what got me approved and saved me from getting an RFE or a denial. :) Good luck!

When I sent my form in back in September, I just JUST the I-129F and the fee. I didn't understand the directions and my 'packet' was severely lacking. There is NO way they would have approved my petition without proof of citizenship, proof of having met, etc.

So when I realized this in January, everyone on VJ said to wait for the RFE. USCIS even told me this. However, I was so stressed I was going to be denied, that I made copies of my entire packet, and I mailed that to my Service Center with a copy of my NoA1 on top.
