How did it go? Did you get to the court house yet?

So it has been one month and the courthouse has not called back (I have followed up) in regards to my old court documents, and the court papers I have from a few years ago will not be sufficient because it does not bear the courts seal (or so my lawyer says). And, I still don't have my fingerprint check back and my interview is in june :(

Any ideas on what I should do now?

Maybe you're already past this point, but I'm pretty sure you don't need the fingerprints. The fingerprints are for if something shows up on the record check. If nothing shows up, then they would have no idea. If your record check is clear then I say leave it be.

June 7, 2010 - Will asked me to marry him, and I said YES!!

March 25, 2011 - Email from Montreal saying that our case would be forwarded to Vancouver - only took one night for a reply from them smile.png

April 6, 2011 - Received Packet 3 via email - now just waiting on my police certificate.
April 13, 2011 - faxed Packet 3 to Vancouver
April 14, 2011 - received Packet 4 via email
May 4, 2011 - Medical appointment
May 5, 2011 - Interview!! APPROVED smile.png


June 16, 2011 - POE at Blaine Peace Arch Crossing
June 28, 2011 - Got married by Elvis in Vegas!
Aug 8, 2011 - Received SSN in the mail.

Aug 31, 2011 - Sent off AOS Package
Sept 7, 2011 - Package received by USCIS
Sept 9, 2011 - Notice of Action email for AOS, EAD, and AP.
Sept 16, 2011 - Received my Biometrics Appt. letter for the 30th.

What AlinaH said is correct. I am going to assume your matters were covered by the YCJA (youth criminal justice act), which prevents your records from being released under most circumstances.

As long as your police clearance says it's negative, you are fine. That's what Montreal works on, it's doubtful they have the ability to run CPIC checks themselves and even if they did, why would they request you to get a check if they were going to do it themselves anyway? In fact, I am almost certain they can't do checks. Montreal is not going to do digging for things that aren't on your police clearance, so I really think you need to relax and let your check speak for itself.

(I work for the RCMP so take the information for what that's worth.)

I agree that they would not know unless it has already been disclosed BUT If one day they do find out that you have been charged in the past even as a Juvinelle. IT can go badly for you.

If you are interested, Call the court house again daily if you must, then if all else fails explain to nvc that you are waiting on the files so this will not slow your case down. Just keep calling and bugging them :)

Yes, this incident was covered under the YCJA. I will def. keep on bugging them. Do you think that the court info I have will be sufficient for the interview? It is the exact copy of the court documents that they give to you, minus a court seal (I guess it didn't show up as it was a photocopy?).

You guys have been a huge help! :)

Edit: I know for the future having all those extra court copies will be necessary, I am just wondering what the odds are of me getting denied because I might not have those two items... :/

You will need the court seal...

heres what I did, Im Not sure where you are from but I called the court house multiple times eventually I got a hold of a court clerk and she gave me her extension so Every time I called I talked directly to her. Weeks later she called me to tell me that one of my files was "missing or destroyed" So she got me one court file but for the other she wrote a lengthy letter stating what the crime was,sentence etc. Both had the court seal.

You will not get denied but you will be put in ap if you are unable to get the court papers before your interview. In this case I would still bring what you have because who knows maybe they will take some pity but it is very unlikely (at my interview they wanted Police records as well but I got away with out em)

IF you have had a criminal history I suggest you get one. IF you have a clean criminal history the general check and letter will suffice.

I hope you don't mind me jumping in on this but what did you mean by " letter"

I just have the CPIC check is that enough or do I need a formal letter from my local police ?

I did exactly as you asked and all they keep saying is that they are backlogged. Each time they give me a different time frame, either 8 weeks or 4-5 months (backlog)!

I just feel hopeless. I really hope that all this does to our file is put it on hold and not a denial. Will they have our passports as well?
