Hi all

Do I need to fill I864 even if I do not have income ? I have my sister as my wife's Sponsor .second Q does she need to fill I-864A?

Who filed the petition?? Who filed the I-130??

Whoever filed the I-130 petition MUST be primary sponsor and MUST provide I-864, even when using a Joint sponsor due to having low income.

Also if you failed to file IRS returns, you will have to explain why, or simply late file them.

Moving to NVC, I-864 for spouse visas is a NVC process..

Petitioner must submit the I-864 regardless of income.

If the sister lives in the same house as the petitioner then she can complete an I-864A. If not, then she would submit an I-864.
