Question about living arrangement

Timeline

I have a question.. My husband became a conditional resident August 2008 and a permanent resident January 2011.. however we were separated for 8 months from February 2009 to October 2009.. the instuctions say that in order to apply for citizenship we would have to be married for 3 years or continually living together for 3 years or something like that.. would this cause a problem for use filing this year or will we have to wait until next year.. it wasn't a problem with the 751 that we were separated.. thank you for your answers in advance :thumbs:

Yes will need to be continiously living together for three years to apply for citizenship based on 3 years with citizen.

Residency began Aug 2008. However it was interrupted by that 8 months, so in order to apply for citizenship, need to start at the time after the 8 month interruption.

What was the cause of interruption? In some cases like US Citizen doing military service, the interruption would not count.

Is now a US Citizen immigration completed Jan 12, 2012.

we weren't getting along at all.. but since he came back in Oct 2009, things have been so much better.. so you're saying it has to be continual.. so we won't be able to file in May of this year :crying:

Well considering May of this year is only 2 1/2 months away, it isn't that long at all!!:thumbs:

You neglected to read about the 8 month period of separation, in order to naturalize based on 3 years of living together the 3 years started after the 8 month separation.

Earliest to file would be 90 days prior to October 2012.

If you had a "Valid" reason such as your spouse had to look after his bed bound sick mum/dad or work related or something in that nature that "could" be over looked..

But for reasons you have given this could open a can of worms you don't need just of now....so simply avoid it by waiting just a little longer, then it won't become a issue later.

Yep it's best to put your application on the back burner/shelf, for now until things settle down a bit..:thumbs:

In the meantime make sure you both file "joint" taxes, before you decide to file..uscis looks at this close when your application is based on 3 yrs.
