My Mexican fiancé's grandmother just died on Friday. Her entire family wants to drive up to San Antonio, TX to be with family just for the weekend but she is afraid she cannot go because of our pending K-1 application. All of her family, including herself, already hold valid tourist visas as they have always frequently traveled there in the past with no problems. Also, we are just in the very early stages of the application process. I've only received the NOA1 and I would be surprised if they've even gotten to our I-129F application in their stack yet.

So what are your thoughts and opinions? Do you think it's a big risk or no big deal? She would just be there 2 days.

first of all sorry for your/her loss

as long as she can show strong ties to mexico, a reason to go back to like some sort of mortgage lease, a job letter stating she is allowed to be gone for the funeral etc, and when they expect her back then you should be fine just as long as you have a lot of evidence as to her having a good reason to return you should be fine especially since she already has a tourist visa... good luck!

First, sorry for her family's/and your new family's loss. Our prayers are with them

Second, good news for you. My fiance (we are still in the final process, as our interview is in less than a month) is here with me in the US, as we wait. Good news for you? Yes, as we know the rules (we ASKED many people, even in face to face interview at the USCIS office in DC).As long as she has a valid, multi-entry visa, she is fine. Just when it comes to filling out the 160 later, she will have to make sure she mentions the trip. Just list all the trips to the US. In fact, as she has a valid visa, she can come up and basically live with you, as the process continues (if you want). She can not tell them that at border, just saying that she is visiting her fiance and that she has a pending I-129F (give her copy of NOA1 for the border patrol) and they will most likely let her come in for 6 months.
