Good day to you.

I am a new member and quite excited to be here. I have a question, does one have to wait on the NOIR from the USCIS to continue their case or is it possible to just refile? The problem though is that it takes up to 8 years in my category, so if I were to refile wouldn't it take that long again? Also all that money was wasted in the intial stage. My father filed for me his married daughter over 21 years of a US Citizen. Thank you!!

The reason for the denial needs to be addressed. If it was an IR-Visa it would need to be addressed, unless you will be petitioned under a different class.

Addressing the NOIR can result in USCIS simply sending the case back for another interview which should result in a visa unless the consulate can find some other reason for denial.

Oct 25 2012 - Sent AOS/IV Package

Oct 29 2012 - Pkg Delivered
Dec 24 2012 - Case Complete

May 17 2013 - Interview-Approved

July 19 2013 - Enter the USA
