Timeline

Moh has his green card, which expires 11/2007.........Can he travel to Egypt to visit his parents for about 10 days? Is there anything specific we need to do before or after? What exactly happens when he leaves USA for a visit and what is the process when he is returning?

I know these questions are simple, but we just want to make sure there is no problems for us.

Yes he can go.

Nothing happens when he leaves.

He goes to the Citizens and Residents line when coming back through the POE and he shows his passport and his permanent resident card.

Hi,

If I'm not mistaken, he is free to leave the country for up to six month with his GK. Thus, 10 days will not make any difference. he is a permanent resident and he has almost all the rights in this country, he can leave and come back as many times as he wants...Just make sure he spends enough time here to be qualified for future naturalization(36 month out of five years probably).

Comments: I had the worst day in my life so far. Was treated worse than an animal, screamed at and and threatened. What is wrong with these ppl???

He hasnt traveled home since he arrived here..........how does this 36 months figure in. I am not clear on that.

That is a bit misleading. There are several factors that have bearing on physical and continuous presence requirements for both maintaining permanent residence status and qualifying for naturalization. It is not that simple.

For your original inquiry, a 10 day trip back home will have no impact on residency.

Actually, cut that to 24 out of 36 months. He'll be eligible to apply for nat'z 36 months after getting GC so long as he stays married to you for the entire stretch.

If he's been working he also needs a sailing permit from the IRS, its free, just go to the local office, bring passport, pay stubs, and return ticket. Its like a tax clearance. They usually never ask for this, but you never know. I had to do it when I was a GC holder.

If you are worried about the number of days that you must have as a permanent or continuous resident and how travel outside the US may effect your naturalization application, go to the USCIS website and click on citizenship, naturalization and there you will find a document "A Guide to Naturalization" form M-476. IT can be downloaded or ordered by mail and has all the answers. What you are looking for should be on pages 18 and 19.
