Alright so my love and I met in 2008. We were split for some time until reconnecting. Unfortunately, now he is in Brazil. I am in America. Right now we're in the LD (long distance) phase of our relationship and I travel back and forth n order for us to see each other as often as we can. In March I am going back down to Brazil for 2 weeks to see him and we want to get married.

I have an appointment with an immigration lawyer here in America next week.

We don't know what way to go, If i should petition him as fiance(k1), marry when I go now in March because most of his family is in Brazil and petition him as spouse, or what to do? We just know, that like others on this forum, want to be together and not living in separate continents any longer. We miss each other and I am trying to understand the whole fiance versus spouse document differences. All these documents just really overwhelm me :(

Do any of you have/ had a similar situation and care to share your best advice towards my love and I? What you? What you should've done? How long it took?

The K visa is quicker by about 2-4 months than the Spousal visa. The K route is more expensive but is good for those who just want cant and want it "now." See the link below.

k1 is quicker but more expensive in the end.

If you'd like to be able to work right away, go for cr1. if it doesn't matter and you don't want to marry yet, go for k1 :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

He would like to be able to work as soon as possible, we are even using a sponsor because I do not make $20k. Wednesday I am actually going at 10 am to see an immigration lawyer. Any questions you guys suggest me asking? I have a couple writeen down, but since you have been through this maybe you can suggest questions I won't think of? Thanks again everyone for responding, this is really helping :)

welcome to vj... if your fileing the 1-129f you don't need a lawyer, save your self hundreds of dollars, do it your self it's easy. vj members will help you along the way.
