Can I apply for VWP as a tourist if already applied as an immigrant and got denied.

I got married and got denied for 212 2a, simple 1st offence possession of marijuana under 20 grams.

You fall under this: Classes of Aliens Ineligible to Receive Visas

You cannot use the Visa Waiver Program.

You also are ineligible to receive a visa.

You may want to check the section on waivers.

I don't speak legaleeze so I can't tell you if you qualify or not.

You clearly have immigrant intent AND you have a drug offence

Not likely you'll be admitted

Oh, and Canadians don't use the VWP. You can apply for a B2 visitors visa, but I wouldn't count on that either

Nope you would not qualify for VWP - for you to enter US would be very difficult - you have in past expressed you have intention to immigrate - it is automatically assumed that if they let you in on non-immigrant visa you will not leave when your visa expires.
