Do we have to fill out a separate form on her, like the 156 form, or the 157 form, or the 230 form. I didn't on my 134 because I had her listed there. Do I need to fill out another form for her.

Here's a question: How did you list your fiance's child on I-134? It may be a dumb question, but on I-134, it says you should list 'spouse and child following', and not 'spouse *or* child following. I'm just curious.

Right, I was unsure whether one should fill out another one for the child, since the instructions say one form should be filled out for each person being sponsored. I won't offer any advice because I have none, except that I think you could try and post it to the Manila thread.

I guess the child needs a K2 visa. I hope this would be automatic if the K1 is filled out right. I emailed the embassy and when they reply will let the board know.

Yes, they have derivative status:

Children Have Derivative Status

The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is long than one year from the date of visa issuance, a separate immigrant visa petition is required.

Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.

Financial documents from the petitioner – a US citizen: please note, that Affidavit of Support (form I-134) is not required, but may be requested. The document must be notarized. Please submit financial documents to show that the applicant will not become a public charge in the United States. Such documents may include, but are not limited to:

- Most recent year tax returns (form 1040) or tax transcripts from IRS

- Copy of bank account

- Earnings and leave statement

- W-2 forms

- Letter from employer

Ummm... those are the instructions for the K1... It doesn't give you any details about the K2, which is what you're looking for. As for I-134, each embassy/consulate has their own 'little rules'. For example, in Manila, they don't like co-sponsor that much. In Brazil, the petitioner has to 125% above the poverty guidelines. Also, the information you posted about the supporting documents is almost exactly identical to the ones found on the I-134 instructions.

It seems automatic except there are some forms you must fill out in duplicate like the 156 form. The site i posted to the Moscow embassy explains which form have to be filled out in duplicate.

The plot thickens; I would do 2 my fiance and her daughter will be applying for k-1, k-2 visas. when i called the Embassy, i was told i need to have a separate affidavit of support for my fiance and her daughter. is that right?

So I guess when I-134 says one form is needed for each person it means one is needed for each applicant - in your case, one for the K1 applicant and one for the K2.
