I posted a lengthy reply in another thread about an RFE I received yesterday, and I'm just looking for some advice.

I packaged up what I intend to send out tomorrow:

Cover Letter with Contents of Package

First RFE letter (stating they need proof of legality of Co-Sponsor)

Co-Sponsor's passport biographical information page (copy)

Co-Sponsor's birth certificate from the US Census Bureau (copy)

Second RFE letter (stating need proof of 125% income of household)

2nd Copy of I-864A

2nd Copy of 2005 1040 for co-sponsor, w/W-2s, 1099-INT, etc.

Bank Stmt of Co-Sponsor's savings (his income already is well above the requirement, but I thought it'd be a good idea)

Pension Stmt of Co-Sponsor's pension acct (to show that, if he were to retire before the sponsorship expired, his income combined with mine would be more than 125% still)

My question is, based on my prior post, which shows the exact wording of the RFE, do you think this is enough? Should I also resend my I-864 and supporting docs, as they don't seem to ask for them? I don't want to send them a ton of information and confuse the hell out of the person working my case (and I know from working for the gov. that workers hate extraineous info almost, but not quite, as much as pushy, ignorant litigants) but I'm worried that instead of a second RFE if they need more info, they'll just deny David's petition straight-off.

I'm a bit confused... which of the documents you listed shows your father's current annual income? Is it the pension statement? In your previous post you said you had submitted a letter of employment for your father -- is he currently employed? If he is currently employed I would forego all the extraneous stuff like pensions and savings and just provide exactly what they asked for: letter of employment stating annual salary, maybe some paystubs for good measure, and 2005 tax return.

My dad's not retired yet, but he might be retiring next year (he hasn't decided) and if he did before my husband got an interview, I wanted to be prepared, but you're right. I was just trying to be proactive, but I might have been a bit carried away.

I disagree with hcj - Go ahead and send the pesion info also - I assume its either a private pesion fund - (I had one before retiring); OR a 401K or a 457 or some other such account. The funds in that show the accumulation of what you have paid, what your employer contributed and the earnings of the fund (or losses.) It is an excellent indicator of length of service and earning power (Its parallel to your social security statement in a way, except the SSN statement doesn't show the employer's contributins.) Good Luck

M, which of those documents is evidence of Dad's current income?

The issue I see in that other thread (not just you) is proof of current income (if any). That is: employer letter + paystubs, right?

We have his 1040 from last year and a letter of employment (which states position, number of years worked, and salary) as proof of employment. It's also why we were going to include the pension stmt -- to show the number of years employed and the continuing employment after filing the tax return last year.

When I sent mine in, I didn't make enough for the last three years (though I'll make more than enough this year) so I sent in a copy of every pay stub for this year, which all totaled add up to more than necessary already, but we still needed a co-sponsor because I didn't make enough in any prior tax year (because of school, which is why in my initial filing I included my 1098-T tax forms -- statements of tuition which show how much my school tuition was each year, proof that I was in school and why I wasn't, until this year, working full time.)

hey M, i don't have your other post up in front of me now, but you did not mention evidence of current employment in the list here previously. Tax returns are not part of showing current employment, so I would focus on what they normally ask for: letter from employer + pay stubs.

How was the determination made that you needed additional sponsorship? Is your current income sufficient for your entire household?

And in the splitting hairs department, Dad is a household member, not a co-sponsor.

Still trying to work out what these I-864 requirements really are these days, tsk.
