You should be able to call once you are outside the "normal" processing time, which according to their website is 5 months. Whether they consider that 5 months or 5 months and 1 day, I do not know.

One strategy that I had was to call them a week and a half before the 5 months, because I knew the phone jockey would say that the normal processing time was 5 months. I then got his ID number and was prepared to quote him on that if they gave me any fuss. Fortunately it was easier than expected for me and they did what they were supposed to without me having to unleash the ID.

we put in a Service request after 5 months and got a Tier 2 to put it in and 2 weeks to the day we got a Email to say they would get an answer in 45 days so last night my fiance phoned again and tier 2 said no we shouldn't of got email and told her where to send an Email that will get to the adjudicator that is working on our case whether it works or not we will see waiting since 26th Aug hopefully hear soon

Maybe they sent you the wrong email. 2 weeks to the day I sent in a service request I got an email that said my petition was approved. And I thought it was only 30 days for an answer when putting in a service request.

Just a quick update on my service request...

I also sent two emails to VSC.Ncscfollowup@dhs.gov and SCOPSSCATA@dhs.gov. I explained that I do not want to wait for 30 days without a guarantee that I will hear something by then. I had some particular reasons for this which could borderline warrant an expedite request, but I have already been denied that. Anyways this is the response I got from officer Mary:

"On February 14, 2011 you placed another inquiry with the NCSC requesting your case be processed due to being out of the normal processing time. USCIS has 15 days to respond to your inquiry. You will have a response by March 1st, if not sooner."

Let's see if they go through on this...

9/9/10: I-129F Sent

9/15/10: Received NOA1 via text/email from USCIS

9/16/10: Received NOA1 in mail (dated 9/13/10)

9/20/10: Touched!

10/03/10: Touched to the dusty shelves!

2/28/11: NOA2 finally

3/04/11: Arrived at NVC

3/08/11: Left NVC and arrived at CDJ consulate

4/04/11: Packet 3 sent

4/13/11: Packet 3 received!

4/18/11: Medical Exam

4/19/11: ASC

4/20/11: Interview (Approved!)

4/29/11: K-1 Visa in hand!!!!!!!!!!!!!

4/30/11: Entered USA

Is this a good sign?

I really think is luck. They didn't opened the door even for the congressman who was inquiring for my status .... huh

In my case I didn't even have to get to Tier 2. They handed me the service request....

I don't think they open the door to anyone. Honestly, they are a pain in the rear. This is going beyond ridiculous. I don't know how they can justify taking so much money from people and then refusing to help!

In my case I didn't even have to get to Tier 2. They handed me the service request....

We finally got a service request yesterday and we're way over the 5 month mark..infact we hit 6 months in a few days. Let us know how yours goes and i'll keep you posted on ours too. See if we can get anything out of them.

Our lawyer contacted them and was told they are working on the case and we will hear in maximum 2 weeks. I don't think he could place a service request ....

Well, they refused the service request after the 5 months mark..i think they've only agreed to put ours through as we're days away from the 6 months mark. I really hope we get something positive next week..this weekend is going to be a long one.
