My Fiance is in America and she is close to her K1 visa expiring. Due to uncontrollable circumstances, we are unable to get married before her visa expires, so what is the penalty if she stays and we get married 2 weeks after it expires?

You said in one post that you are away for 2 weeks. How long has she been here this is my question and you are only now thinking of marrying and its a problem because you are away for 2 weeks? Why did you not do this before now if she arrived weeks ago as you said her I-94 expires soon so she has been here a while then? Sorry I am so confused with this but your statement of being away only 2 weeks got me thinking.

Well, to the OP, I really hope you have received some kind of help. Of course when you make such a post, many questions will be asked and its something you have to be prepared for. I, too, have a job that is not as flexible. I leave my home for long periods of time and there is no way out of it. Most people with a regular 9 to 5 do not understand what it's like to be tied into a schedule that has you traveling or working for days upon end away from home. I suppose you have learned a bit of a lesson in the planning department as you have been pushed to the last minute to take care of some important business. Also, I know this may sound a bit strange, but maybe looking at the action of getting married as a duty and responsibility might help. It something you have to get done or there will be some major consequences. Just wondering if that might help you.

So, I was once an active member of lovingyou.com due to the uniqueness of my relationship. I really was at a point where I needed help and support, that of which I found. I also got introduced to the other side of the coin. It never ceases to amaze me that people take the opportunity to insult, bully, be clique-ish, funny, and selfish when someone genuinely asks for help on a issue. They take the opportunity to make assumptions while forgetting the golden rule about what it means to assume. I loved being apart of that site until I saw how mean people can really be. No, life is not always sunshine and lollipops and everyone communicates in different styles. An appropriate sense of humor, straight talk, and tough love are definitely needed at times but I think people know when they are being _______...well, I won't say the world I want to say but I am sure most can fill in the blank. I loved being apart of that community but got tired of seeing the same people be "know-it-alls" and down right mean when someone didn't play by their rules; or when someone was unaware of something that one person sees so simply. So, I haven't been back to that site in a long time. When I found visajoureny, I thought, "here's a site that is different!" People here genuinely want to help and leave their presumptions and judgements at the door for the most part. I still believe that about this site. I really would love it if this site continued to maintain its integrity, empathy, intelligence, reason, and sense of human connection and not just become a place where people are mean. Am I judging? Perhaps a bit.

For those of you who get immediately taken aback or offended by this, my advice is that you re read all of the posts you have made or just a few and look at the tone of it. How did you come off? Were you being helpful? Do you have a trend of jacking threads and what is your goal in doing so? Did you parents ever tell you, if you don't have something good to say (in this case helpful), don't say anything at all? Why are you here at this site? Also, whether you'd like to accept it or not, when you are an administrator, you are seen as someone who holds himself or herself to high esteem and an expert in some matters. If you are someone with many dots under your name stating your level of membership, by the stranger or visitor to this site, you are also seen in the same light. Just something to think about.

Apr. 14, 2010 - Left NVC for Dominican Republic

Apr. 22, 2010 - Consulate Received!!

May 24, 2010 - Packet 4 Sent (Still haven't received it...)

Well, the two forms serve the same purpose. But the I129F is really a bit more "nosey". Asks all sorts of questions of the petitioner like if they've have a criminal conviction. If the petitioner met the beneficiary through the services of a marriage broker. If the petitioner and beneficiary have met in the last two years.

So here is the definition #2 from dictionary.com for equivalent.

"corresponding in position, function, etc"

Equivalent is not equal. Therefore, I stand by my initial statement that they are equivalents.

If you give a generalized question that seems to ask, "What can I do to circumvent the system because I didn't prioritize what should have been a priority?" you're going to get a bunch of snide responses from people that have spent a good portion of their time & energy trying to accomplish the same thing.

If you explain your specific situation, then others who have been in similar binds can try to help.

Come on --give the guy a break . we do not know his circumstances and he do not wish to explain . He have a job that requires him to be away for a while or on a ''special mission '' or deployed in a foreign country etc . He know the consequences and is willing to pay for it . Best wishes .

My point exactly!! It's just sooo annoying sometimes when ppl jump to conclusions without knowing what situation the OP is in...someone even had the nerve to say 'Why apply for the visa if you didn't plan on getting married'... we're all on VJ to seek advice, if you have nothing good to say then please just don't say anything at all...

Wow, ok. So, I guess if one makes a post one should stay glued to the computer in order to see how the post is coming along. Did you ever think for a moment there was a reason why this person didn't respond? I have been in this same boat. I fly all day. I have made a post and not been able to see anything or respond to it because I was working...on a plane...with no computer. Is that a good enough reason for hours to go pass in between responses. I think it may be called working or having a life. Oops, sorry, didn't mean to say that if you have time to respond immediately to every post in a timely enough matter, according to your standard in which hours is too long, that you don't have a life. I think you get my point though, right?

Now, this whole part about rephrasing the OP's question is only to prove your point of view and response and that is probably not the best practice. That is assuming. Oh, and because one person has put a little more effort into an action and someone else has not, they should get different results? I will equate that to an individual who never does any homework, studying or note taking yet can take a test and get an excellent grade (my husband). The person who did all the homework, took notes diligently, and studied until their eyes bled (me) feels slighted by the person who did not do those things. So, the slighted person, the one who studied, thinks its unfair that the person who didn't do the work or studying doesn't deserve the grade (I don't feel that way but I know many who do...). Naturally, if you don't do hard work, you won't get good results. At least that is what society has us believe. But we are all talented in different areas. We are all different. We all have different styles of working. Maybe the OP procrastinated for whatever reason and now has to deal with the consequences. Oh well, that's life. Good luck to the OP who has made his/her bed. I don't think those of us who did what we had to do have the right to pass such harsh judgement. Just sayin...

Chavonia - it's human nature to speculate. I personally don't feel anyone here was that rude or judgmental to the OP, just wondering aloud (or in this case, in text) as to the predicament he's in. Good advice was given - there's really no more issue that the OP has now that he has his answer. You have to admit it's a pretty strange scenario to jump through all the hoops to get a fiance here, then not leave enough time to get married. It's not usual. That doesn't mean it's bad - it's just different. People will comment on such.

And if you think this thread is out of line, you are going to be sorely disappointed in some other threads you may wander into. My best advice would be to report anything you find offensive and have a mod deal with it, or just speak up and have your .02 like you did here.

Which expiration date are we talking about??

K-1 visa expiration has nothing to do with when to marry, or file AOS. K-1 visa expiration has only to do with when need to use visa by to enter the USA nothing else.

Marry within 90 days after entry to the USA, if fail to do this it is not the end of the world, however will need to attach an I-130 + FEE to base the adjustment of status on.

Has it occurred to you that the OP has his answer, needs no more assistance and considers the rest of his situation to be simply, none of our business?

It has occurred to me. Frankly, whenever in real life someone asks me for advice, I ask questions to help in giving the best advice. I would consider it not only extremely rude for that person who asked for my assistance to just ignore my questions and walk away. (I'm not talking about now; this was prior to the OP exiting the conversation.)

I simply reject the notion that someone should be able to say, "Please help me with my problem. What should I do?" but then say, "The problem is none of your business."

Now, I'm not "yet" an expert in immigration (so of course my experience refers to other topics in which I would be more knowledgeable). I'm trying to hang out in the forums to learn as much as I can, even that is not related to my case, so I can help people in the future. But, frankly, if this is the way people act when they say they want advice, I doubt I'll be interested in ever helping that person... not b/c I don't want to, but because I don't think you truly can without having all the information.
