I-485 AOS application and I-94 Copies question

Timeline

My Story;

- I am an F1. I transferred schools in 2006, Silly enough, after I transferred to my new school, I didn't go to my new school's International Student Office to receive my new I-20.

- So 3-4 months within the semester, I received a letter from USCIS saying that I am out of status. They thought after leaving my previous school I never attended any school.

- Hired a lawyer and filed I-539 Form(Application To Extend/Change Non immigrant Status). After two court appearances my application for reinstatement was approved. So I am F1 again.

- Shortly after that I received my passport back, which they initially took from me. But there was no I-94 card in it and now 5 years has passed since...

- I have the I-94 Form's photocopy and everything on it is clearly readable/visible, except for the stamp for re-entry. There's a stamp on my passport clearly states my re-entry date though.

So considering my above story; I have 2 questions;

- When I am filing the form I-485 AOS. They require for me to send the photocopies of I-94 which I have that is fine, however, that stamp is not visible on I-94, would I get an RFE for this?

- Should I send my AOS package concurrently with I-102 Form (Application for Replacement/Initial Nonimmigrant Arrival-Departure Document)?

10/06/2014 - (Day 102) - Responded RFE

01/23/2015 - (Day 211) - Naturalization Oath Ceremony

01/23/2015 - (Day 211) - US Citizen

Timeline

Copy of I-94 is fine, no need to order a replacement.

USCIS can pull up entry exit record by the printed number on the I-94, which should be readable in a photocopy.

Is now a US Citizen immigration completed Jan 12, 2012.

oh yea the 'Departure number' is absolutely readable, what is not readable is the stamp which would probably was the entry date stamp.

But like I mentioned there's a stamp on my passport next to my visa that states my last entry date.

so no need for a I-102 Form you think?

Nope, no need to the I-102

I agree no need to waist your money on filing I-102 in your case - your record of entry is in their system and with all other numbers being clear and legible they definitely can find you in the system and get any info they would need.

- little side note, I had to apply through I-102 due to my old passport no longer available and the IO at the interview had a puzzled look in her face when she saw the replacement I received prior to filing AOS, she didn't even keep it at the end of the interview.

10/13/2010 - Mailed in The Package (AOS, I-765, I-130)

10/17/2010 - USPS confirms delivery to USCIS

10/25/2010 - Check cashed

10/26/2010 - All applications been worked on aka touched

10/28/2010 - NOA1 Receipts for applications received

11/24/2010 - Received appointment for biometrics in the mail for 12/17 *yay*

12/17/2010 - 9.25 a.m. - 9.45 a.m. Biometrics done !!

12/23/2010 - EAD Approved and Card on its way - Email notification received *yay*

01/03/2011 - WOOOHOOO ...EAD Card in Hand!

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/09/2011 - Yup another e-mail saying that my card production was ordered.

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done

Hi, Could you tell me what your final decision was? Did you apply for a replacement? Or, did you apply AOS(sent them the photo copy you have in hand) without a replacement?

I am in the same situation.

Entered the country with F1 (still have the original I-94)

Found my first job and got and H1B (New I-94 was sent with H1B status on it)

Found another employer and apply for a new H1B (I only have a photo copy of the I-94 with my new employer's name, my immigration status and expiration date on it)

Now I am happily married to a US citizen and preparing to file AOS myself! :)

Her is the questions:

Would they ask for the "original" I-94 (not a photo copy) at the interview?

If I do need a replacement (now it is $330.yikes!), can I file it concurrently with my AOS package?

What should I put in I-102, Part 3 Are you filing this application with any other petition or application?
