My wife didnt make enought money last year so she didnt sent her W2 to IRS.We have a joint sponsor but she have to fill a I-864 form too.At the C point when they ask how you fill the income tax there 5 checks and we dont know what to check. We found out that we need to send a letter and explain why she didnt sent her W2 to IRS but we also have to fill the form complete to avoid the risk of sending the papers back to us.Thats the only thing we need and we can send the papers.Thank you so much

Its always wise to file your taxes even if you didn't make enough money - as many times you may be eligible for a refund (even if its a small refund why give it to Uncle Sam?) Having to pay taxes and filing tax returns are different things and for those of you thinking of owning a home (and sometimes even leasing one) you should get in the habit of filing your taxes. Also, remember if you have kids - Uncle Sam will pay you (Earned Income Credit etc.) So, be wise and help yourseves. Good Luck

Okay, but if someone just didn't file a tax return, what's the procedure for the I-864? Say they had no income and no W2.

heishe,

One must submit either a copy of the income tax return that was filed or an explanation of why one was not required to file an income tax return.

"just didn't file a tax return" is not an acceptable explanation.

cristian,

You can do what you're supposed to do - in lieu of a tax return supply a valid reason under the tax code why there is no tax return.

Is "I had zero income last year" a good explanation for not filing?

heishe,

Yes.

Some people also include the evidence from IRS that they are not required to file based on income.
