my lawyer says we cant apply for the K3 visa, but the USCIS website says we can?

does any one understand what this is about?

Salin and other VJ friends: Here is an update for you. My IV Fee bill is "in process" as of today (03/03/2011). Sure is a good feeling to be in the NVC rather than TSC.

This week I sent in our year 2010 - 1040 to the IRS, married filing jointly with W-7 (for ITIN #) and 2555-EZ (foreign earned income exclusion). Also sent in 2011 estimated, to the IRS, so that the NVC can see that I am still employed. Then sent all of the foregoing along with the I-864 to the NVC.

Celldoc. Glad to see that the USCIS finally sent your documents to the NVC and you now have a case number.

Does anyone know how much expense will be forthcoming at the American Embassy in Jakarta (for the medical, visa, etc)?

i have one more question if you dont mind.

My wife is living in Tehran, Iran. The protest are not as bad as Libya, but there still are protest and it has gotten a little more dangerous.

My reasoning could be i dont want it to escilate and it get dangerous for her or make it harder for her to come here.

Does anyone think this is a good reason to expedite through the NVC?

Or should i not even try?

i was told a denied expedite can delay the process.

so im hesitant to try it

That sounds ridiculous..................request the expedite with the assistance of your Senator(s) or Congressman. If the US Govt can grant 55,000 emergency visa's for Haitian's, I don't see how they can not do it for someone in your wife's situation.

thanks for the vote of confidence. I will look into how to get this done tomorrow. i have already contacted my local congressman but they didnt do much for me during the USCIS process. lets hope i can convince them to help me a little more this time.

and I also think this site and help from all you guys is all oneyone needs to do this. The lawyers cant do anything!

i feel like they haven't helped me at all. I have done more work in trying to figure out whats going on with my case, and i have gotten more answers than my lawyer has.

Received NOA2 hardcopy today, well technically yesterday (Thursday). Hopefully they have transferred off my case to NVC or will do it soon. I'm remaining patient though.

I'm exhausted and so happy that the week has is coming to an end. I need to catch up on the thread, but that will have to wait until tomorrow. *yawns* Goodnight guys, I will check in tomorrow.
