:) the key is having a very good reason/excuse for not being able to file w/in the 90 days, -ex. money, a family emergency and explaining this very well in writing

We're the case that someone posted in a link to in their reply. We're still waiting to hear but then so is everyone else who filed in November with VSC. We did have a reason that I was very truthful and honest about. I explained in detail the cause. It was accepted, our check was cashed, and we have been for biometrics.

Get it in ASAP. Write a heartfelt letter explaining why its late. Its really not THAT late (compared to ours). Good luck!

You supposed to file 90 days before the expiration date of your green card...but you still can apply the I-751 however you need to write a letter,a good valid reason why you filed late and any evidence if possible...

No, you are not, file the I-751 ASAP, I have read may times USCIS accepts a late filing up to 30 days past due if you attach a letter with a good explanation why it is late.

Just an update it's me "BackFromTheDead" I forgot my password so I had to create another one.

After I've filed the documents like you guys told me to do so with evidence and everything else. They sent me yesterday I-797C, NOTICE OF ACTION

It says that they've received the money..

and it starts

"Your conditional resident status is extendted for a period of one year. During the one - year extension you are authorized employment and travel. (This extension and authorization for employment and travel does not apply to you if your conditional resident status has been terminated"

"In order to further process your petiotion, you will be receiving an Application support center ASC appointment notice with a specific time, date and location to capture your fingerprints, photo, and signature. You MUST wait for your appointment notice before going to the ASC for biometric processing.

NOTE: Conditional resident applicatns, including conditional resident depentends residing overseas pursuant to military or goverment orders will not receive an ASC appointment notice. To complete biometric processing, these applicants must submit the required items listen on the I-751 form instructions.

If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your pemenant residence. PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but is not limited to, the following items:

- Lease of joint tenancy or joint ownership of assets.

-Joint mortage agreement and/or propery deed.

- Tax returns

-Birth certificate of any child born from the marriage.

-Joint policies of life, medical and/or car insurance.

You won't be deployed unless you are a soldier heading for the war zone. You mean deported. Nope, you won't be deported that easily. If they would not accept your I-751 you would have a date with an immigration judge at which point your attorney would ask the judge to put the deportation proceedings on hold and allow you to refile. Most likely, the judge would okay this.

But back to your question.

What you now have received is an extension of your Green Card, until USCIS says otherwise. Your package has been received, one of the robots has looked through it, deposited the check into USCIS's bank account, and put the file on the bottom of a big pile. Eventually an immigration officer will grab it, look though it, and may or may not approve it. Whether or not that happens is anybody's guess. But even if he or she then says "wait a minute . . . " you wouldn't be deported. Your petition would simply be denied for being submitted late. Then the games begin, but deportation would still not be on the menu for some time.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . .
