Hi guys,

I have a question about the Green Card. What exactly are the rules for having one? Does it mean that my fiance will be able to enter and exit the States freely as much as he wants? Is there a minimum amount of time that one needs to spend in America with it? What about working overseas? I heard somewhere that if our American employer sends us to work overseas that it still "counts" like you are living in America. Does anyone know if this is true or not?

A green-card is for a Non-US Citizen to reside in the USA permanently, it is not a "Permanent Visa" for the convenience of coming and going, the POE does track he coming and going, and can detain a person if they determine if they may have been considered to have abandoned residency.

Abandoning Permanent Resident Status

You may be found to have abandoned your permanent resident status if you:

  • Move to another country intending to live there permanently
  • Remain outside of the United States for more than 1 year without obtaining a reentry permit or returning resident visa. However, in determining whether your status has been abandoned, any length of absence from the United States may be considered, even if less than 1 year
  • Remain outside of the United States for more than 2 years after issuance of a reentry permit without obtaining a returning resident visa. However, in determining whether your status has been abandoned any length of absence from the United States may be considered, even if less than 1 year
  • Fail to file income tax returns while living outside of the United States for any period
  • Declare yourself a “nonimmigrant” on your tax returns

Only certain employment overseas can be considered to be resident, typically having to do with work for the US Government.

Timeline

for your GC to be valid you have to spend maximum time in year in US.

If your employeer sened you overseas for work then that does not count as you living in US, but if US govt sends you for the government work then yes that is counted as your time in US.
