Hello,

I have a question about the income requirements for affidavit of support. Last year I had an income of 30,000, and I had 4 dependents 5 with myself. And yes I know thats a little bit for so many people. However my mother and brothers are now working. I claimed all of them on my 2010 taxes, so I believe I'm under the povertly line. However, now in 2011 I have the same salary but just supporting myself. So how does this work in my situation? would I have to wait til I file 2011 taxes in 2012 before I qualify to sponsor someone? Thank you,

Moving this to Embassy/Consulate forum, Affidavit of support does not come into play until visa interview at the consulate.

Is now a US Citizen immigration completed Jan 12, 2012.

Hello,

They may consider them to still be your dependents if they were declared as your dependents on your most recent tax return. It would be difficult otherwise for you to prove that they're not still your dependents. If you're sponsoring someone for an immediate relative visa rather than a K visa then you might be able to get your mother to sign an I-864A, which would allow you to add her income to yours to help you qualify. Otherwise, you could get a joint sponsor who qualifies on their own.
