Idea when to file Tax to save time

I know someone will yell at me, but here I go. What if I don't file my tax until I get a Interview date in 4 months. Once I submit my NVC paper work, all that is left for me is to turn my 2010 tax at the Interview day.

Here's why:

My current situation is that I just received my NOA2 and will get my NVC package very soon, and plan to send it off right away. During which time I will still be in the window of being able to file my tax return before April 15 and 18th. If I file now, I will push back my submitting the NVC in the end the whole CR-1 process to Sept-Oct for my wife to get here.

If I file my tax return after I submit my paper I would have allowed enough time for my CR-1 paper work to go through to the Embassy stage. And would be able to take my time in 3-6 weeks to received a ITNI (Tax ID) for my wife, and then I can file the paperwork on April 10.

My question is when the AOS form request a recent tax paper work I would have the 2009 one and 2008, but not the 2010 because I will not file yet. And then on the interview date which I hope it will be 2-3 months after the tax deadline I will get a IRS transcript for 2010 if needed to show at the interview.

Help me does my logic have any possible holes or is this just a stupid idea. The main reason I am trying to avoid the delay of get the ITHN(Tax ID number) and besides the fact that I am also consider head of house whole because of my two parents not living with me. So trying to avoid the confusing of what status to file right now. I figure I wait off to get the Tax ID and then file as Married Separate or Jointly, that I can figure out later.

Tell me your feed back...will much appreciated..very much..

04/16/11 RFE issing my spouse passport biopage

04/18/11 Email back the missing paperwork for NVC

04/19/11 Email from NVC they recieved the RFE I sent.

04/20/11 Spoke with NVC they say have to wait 20days for change

05/16/11 Spoke with NVC they say "case is complete, and that their interview appointment is full for June- to call back in June 17 for a interview appointment time for July most likely."

05/16/11 SIF on the payment portal website

05/20/11 Interview letter arrived via email for June 15 interview date in Guz

06/13/11 Medical Test today

06/15/11 Doc intake

06/16/11 Interview day waited for my wife at the embassy

06/16/11 APPROVE

06/18/11 Visa in her hand at China post office

6/23/11 Land in US at San Francisco airport

7/11/11 Waiting for her SSN card, received her Green Card Already

If your Interview is before 18 april, which I doubt, the Interviewer most likely will not ask for the 2010 tax return because the return is not due. If your Interview is after 18 april, the Interviewer may ask for the 2010 tax return. If you look at other timelines here, you can see things move slow most of the time at NVC, and Guangzhou compared to Visas to other countries.....

YOU can get in/out of NVC in about 35 days now, IF you OPT IN to NVC Electronic Processing.

If the interview date is past the 18th, expect her to hand over a 'CURRENT' I-864, with CURRENT tax documents.

IMO, I think it's worth the risk, really, to not file now, unless you've had a significant change in income.

Would this be ok, if I do my 2010 Tax return now and sent a copy w/ 2010 W-2, and of course I will have 2008, 2009, tax return and W-2 and IRS Tax transcript which I have in my hand right now and also current employment letter and 6 months of pay stubs All this will be sent with I-865EZ with my EP precess.. And then at the interview which by then get I will be able to get a 2010 IRS Tax Transcript.

No matter what I will have to file my 2010 Tax before April deadline, so I figure better to give it to them now and later a transcript for 2010 Tax.

Yes, it will be OK. You do not need the 2010 IRS Tax Transcripts, the copy of the 2010 return and W2 is good enough.

07/07/09 : Married

08/18/09: I-130 Sent to Chicago

08/20/09: I-130 Received by USCIS

08/25/09: NOA1

09/22/09: NOA2

10/05/09: Received case# and gave emails

10/07/09: Received DS-3032 and AOS email

10/09/09: Sent DS-3032 email to optin electronic filing

10/15/09: Paid both AOS & IV fees

10/16/09: Received email electronic filing accepted

10/18/09: Sent AOS via email

10/23/09: Received email that AOS was accepted and waiting for IV

10/27/09: Sent IV via email

11/10/09: Signon to payment failure

11/19/09: Received email for interview - December 14th

12/14/09: Approved for Visa

12/16/09: Received Visa

Rin's interview was in mid-April. I had not yet filed my previous year tax return, so had the transcripts from most recent years available and my roughed-in taxes from the previous year (plus W-2s and paystubs showing proof of income) and my receipt where I had filed for an extension to file taxes. Wasn't a problem.

10/12/2007 - Everyone back to USA!

I don't really want to go the ITIN route plus I'm not in any big hurry to get back a refund nor do I want to file now and ammend later as some people on here have done so here's my plan.

Do my I864EZ with most recent tax year (2009) + pay stubs from fiscal year 2010/11 (in case they want to see current income)then do an extension(form 4868) for the current year. That will buy me 6 more months. By then, my wife should be here with a SSN and we can do married filing jointly.

I'll go ahead and do my taxes for 2010 (just not file them) so I'll have them and a copy of the extension I received if they want to see them @ the interview.
