Hey everyone, I realize this is a long shot, but here goes. My application for AOS off a K1 visa is currently with the MSC. My question is am I eligible for any benefits legally or anything of the sort, whilst I await my work authorization. Any help would be more than grateful!

Thanks everyone,

Olly.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Any income legally whilst I am waiting for my work authorization. I feel that there must be many people who don't have an income whilst waiting for work authorization, so was wondering if there was any specific entitlements.

Olly

Are you looking for some type of entitlement to pay you while not working? Like unemployment insurance even though you haven't had a job?

If you mean is there a way you can work- no.

If you mean can you receive any government benefits (unemployment, help with housing etc)- no; your spouse is supposed to support you, hence the Affidavit of Support.

Is this a joke? Has to be! 'specific entitlements' you must be having a laugh.

Olly, you knew you wouldn't be able to work for a bit when you and your spouse filed for the visa, right?

Alright chill out some if you, was just a question. I've worked hard all my life, and am finding it difficult atcthe current time. Like I said I knew it was a long shot, and didn't think so, but isn't this a forum where you discuss things. Thanks to the people who helped. To the others, well just have a think that some may not be as fortunate as you.

If you were diligent in the prior weeks, and have SSN in hand - you can go open a bank account with your monies

and then trade USA stocks with an online broker.

You can also go to a casino, any winnings there are yours...

that is 'legal income' for a person in your position.

----

as for 'entitlements' - alas, in the USA, no. Unless you are identified as 'indigent' by the local authorities - and if you attempt to be properly evaluated, 'they' will find out yer immigration status, report to ICE.

Anything else available to you, for you, requires careful evaluation of YOUR situation, and you'd have to be unmarried to receive the lionshare of 'entitlements' or 'benefits', comparative to being 'homeless on the street for a full tax year' before you could actually qualify. Mostly.

There are FREE lunch programs that not do this evaluation - but I think the price of gas to 'get you there' offsets the costs savings to your new spouse. Need FREE ESL classes? Those are available in your area. Need Clothes? Those are available in your area, but you must find the proper charitible organization in your area and BEG. I'll suggest you look up the local office of 'Catholic Charities' and go in for some intake - they might be able to assist you with the redefinition of entitlement in the USA (among other things)

I'll ask again - what is your concept of 'entitlement' ?

In this context it is important to note that an immigrant is not eligible for 'means tested benefits' within the first five years of having received the Green Card, which miraculously coincides with the time a resident can become a US citzen.

The US government wants to make sure that the American people doe not have to pay for immigrants. For that reason USCIS is self-funded -- hence the high fess -- and an Affidavit of Support is required from the sponsor.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

What country is the OP from, and if the spouse needs assistance, i.e such as food stamps, the spouse(USC) can go to their local socaln service office and inquire about assistance for themselves. The spouse can then share their part of the wealth with their partner. So as Darnell as ask, what does the OP means by entitlement? What are they looking for food, housing, spending money ?

In many European countries an immigrant would be eligible for some benefits right "off the boat", just for being poor/having no income. So no need to jump on the OP, he/she could simply not realize that US has a very different approach to this...

To the OP: Just Bob is right, you pretty much get no means tested benefits for the first 5 years. On the bright side, once you can work, it is much easier to find a job in the US and you probably will earn more.

June'07 NOA2 per USCIS website!

Name a country where you are eligible for monetary benefits when you have legally migrated under a family sponsor visa. None, unless you are migrating under a special program.
