Hello there Im new on this website. :blush:

My Name Is Yesenia Im 20 Years Old And now I became curious about my legal status.Parents brought me to this country when I was 9 years old I came in with Visa (MEXICO), My father became resident back in 2007 with My sister (USC). He then yet submitted I 130 Immigrant Petition for Relative Fiance(E) OR Orphan Unmarrried Child under 21 pf Permanent Resident. My receipt date is February 22, 2008 and Priority date Feb 18,2008. Notice date is March 10 2010. California Service Center

My question is I ask my dad whats next and he doesnt know we have a lawyer The one who help my dad become a Resident. I wanna know whats the status on priority date or if I have to fill out a form Im getting scared because I turn 21 on July 16 will that effect anything.

Also My Fiance wants to get married to help me out but I dont know if thats a good Idea.

Any help I can get will be great thanks!!!!!! :help:

Well....currently ur Category is F2A- Spouses & Children under 21 of Permanent residents and ur chargeable country is Mexico. Currently the PD on State Dept's Visa Bulletin for F2A is Jan 1 2008, but since ur chargeable country is Mexico the PD for Mexico is 1 April 2005, so u r nearly 3 years back of ur date becoming current.

Now, if u turn 21, ur category will be converted from F2A to F2B- Unmarried Sons & Daughters of Permanent Residents. But ur PD will be the same. Now, the PD for F2B for Mexico is way behind i.e 1 July 1992 so a gap of 16 years.

In the mean time if ur Father becomes USC then it will again get converted from F2B to F-1-Unmarried Sons & Daughters of USC retaining old PD. Again PD for F-1 for Mexoco is 22 Jan 1993...not much Difference.

Well...if u want to Immigrate United States early ur second option is better i.e Marrying a USC and immigrating as an Immediate relative...coz there is no cut off dates of Spouses of USC and visas are immediately available for them.

But u haven't mentioned whether ur Fiance is USC????

First of all my birthday is July 16 too!! anyway...

I'm on the same boat as you only Im 18 and with the current retrogression im sure by the time I am about to turn 20 the situation will be the exact same.

My PD is November 10, 2010 so I have no idea how long all this will take for me. I would really recommend getting married to your fiance though, my sister did that and she became a resident instantly...and later her citizenship.

7/14/2011: Got married officially

10/26/2011: sent I-130 I-485 and I-765

11/03/2011: received NOA1 for I-130 I-485 and I-765

11/23/2011: Biometrics appointment for I-485 and I-765

My PD is November 10, 2010 so I have no idea how long all this will take for me. I would really recommend getting married to your fiance though, my sister did that and she became a resident instantly...and later her citizenship.

In the other topic you started, I made comments pointing out the risk for Mexican citizens to fall from F2A to F2B … so I hope that helped you to understand better your current situation.

I say if you boyfriend is offering help … you go right ahead and take it. But be aware that your original petition from 2008 will be lost once you get married and if the original petitioner is still a LPR. Also be aware that for CR1/IR1 your are going to have to prove bona fide marriage, which is quiet more difficult than just proving family relationship for F2A. Still it´s your best option !
