Hey guys!

I just joined the site because I will be moving down to Florida from Canada in order to be with my partner (not engaged officially, more like engaged to be engaged). We met on World of Warcraft 4 years ago, and while he no longer plays, we've maintained contact through instant messaging, and only recently started an official relationship.

We've been discussing options for getting me down there, and frankly, we're both kinda lost. I don't know whether it would be easier to try to pursue a work visa or the fiancee visa, or another route entirely. I don't particularly know (yet) what is involved with either of those, and am feeling pretty overwhelmed by the entire process.

So... if anyone has any advice, or particular topics or links that would help, I would love to hear from you. :)

I'm glad to be here though, this site looks like a great resource.

Hello!

You may find it surprising, but legally migrating to the USA is not as easy as you may have thought. No route is easy or quick, I am afraid to tell you. Take a look at the "Guides" and read on the different visa journeys available if you plan to become officially engaged or marry your man.

In order to get a visa through an employer you would have to have specialized skills and/or talent and a company willing to sponsor you.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

K-1 is easier and faster than a work visa. In this economy you're looking at a difficult time not only finding a job but a job with a company willing to sponsor an immigrant (which requires them to say why they cannot hire an American)

You an file the K-1 today, no need to get formally engaged

Canadians cant just move to america to live with their boyfriend/girlfriend. Many think they can. You will be turned away at the border and told to go back home your not moving to America without a visa.

You will need to have the USC Petition for a Fiance visa, then you will apply for the K-1 when the petition is approved and you will have a medical and an interview in either Vancouver or Montreal.(Toronto only has a medical, you could do the medical there but no interview there.)

Check out the guides section and look at the K-1 guide. They have good step by step information, it can be very easly done without a lawyer(extra wasted money).

K-1 is much easier to obtain than a work visa, you have 90days to marry after entering on the K-1 and then you file for AOS, EAD and AP are optional, EAD lets you work before you get the green card and AP lets you travel before you get the green card.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

Thanks guys!

I was aware that it is not easy to simply move down there, nor would it be an easy process either way, we're just still discussing options right now.

I read the K-1 Guide and Wiki (awesome resources, really helped me understand the process), and it looks like that's probably the way to go, but Nick is still somewhat apprehensive of the whole process having major ramifications for him if things go wrong (not necessarily relationship-wise, but in other ways).

I really appreciate the info, it's already clarified so many things for me. :)

Goodluck and don't worry, it only looks overwhelming but the process is not as hard as you think, but its quite long! have an awesome visa journey :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Welcome to Florida Jocelyne !! (or soon to be welcome!) Do you know what part of Florida you will be in? :star:

The K1 process is long but thoroughly worth it, my fiance and I found the book, Fiance and Marriage Visa by NOLO, to be VERY helpful along with this site!! Your fiance can find the book in any library. The book laid out each step clearly and specifically which was great for someone like me who need things like lists and charts. And they explain the forms in simple terms for those of us without legal degrees! :lol:

2005---We met by friend/Church member that was living in Nigeria

2006---We begin to talk about getting married

2007---I was going to met him face to face, but hurt my back couldn't walk..

2009---Was able to see each for the first time.. I got my engagement ring (WOW).. :wow:

2010-01-22 mailed I129f

2010-01-26 got NOA1

2010-05-12 called to see why no NOA2, I was told that our case is not being processed yet!!!!! No notes in the computer

other then the mailing of the NOA1!!!!!!! :angry:

2010-05-18 called SERVICE CENTER again to see what's going on with our case.. NOT BEING PROCESSED YET I WAS TOLD AGAIN!!!

2010-06-16 Got notice that NOA2 was approved 141 days after NOA1. We got our approval on Ossy's Birthday.. Happy birthday honey, I love you!!!!

2010-06-21 got NOA2 in hand

2010-06-22 called NVC to see if papers was there, but was told that my DOB was not right in the system. Just mailed a letter along with a copy of my birth certificate asking to change my DOB.. Way to go VCS..

2010-06-22 NVC received the case

2010-06-23 Case sent to Embassy in Barbados

2010-06-28 Embassy received our case

2010-08-09 Interview Administrative Review

2010-11-15 Approved for Visa (I was on the mission to make sure the INTERVIEWER that we had never interviewed anyone else and I did it).. Know that you have right and don't let the interviewer cross the line..

2010-12-10 Visa and Passport in hand!!! Thank God!!!

2010-12-19 Ossy will enter the States!!

That is a very pretty area, he has to take you to Daytona Beach for the insanity that is Bike Week. I live about 2 - 3 hours south of where FIT is. :)

I know what you mean about planning ahead! My man has never seen a beach before(like a real beach, not a lakeside "beach") so I am already planning snorkeling, kayaking, boating and "swamping" excursions! He cannot swim but I already have an instructor lined up for him. You cannot live in Florida and not know how to swim!! :lol: We both are very outdoorsy and it will be great to have a partner to share the experience with.

I hope you find Florida to your liking as long as you are here. B-) Good luck to the both of you! Remember to enjoy the journey and when the hard times come, talk it out! Well... we're officially engaged now!!

I just got back from Florida on Tuesday after a week down there, and it was INCREDIBLE!! If I had any doubts about us being made for each other, this trip definitely got rid of them. He and I have amazing chemistry, I fit in with his family, and I really felt like I belonged. Not to mention the weather was perfect the entire time. Made it very hard to leave, that's for sure. :(

So, we're getting the documents together now, and should be filing for the K-1 Visa early next week.

This site is a LIFESAVER!!
