Denied at POE

You have stated in a previous post that your SO was 16 when all of this happen, now with all of this being said if the visa was a valid via then you’re SO had to have gone for an interview. When you filled out the K1 petition did you indicate that you’re SO had a visitor visa that had been canceled ?

I underStand why it was taken away, my issue is that he has no documentation on his end of what happened only his memory of what happened. Sometimes when people go through things especially at a young age you try to forget it not thinking that one day u will need to deal with again. Dont judge my fiance, im aware of what he did i just dont feel right about not having documentation from govt to support.

You can file an FOIA with the Customs and Border Patrol to get the information on her file but that takes months

Agree with this, if you want the papers that tell you exactly what happened file a FOIA. Then you will see what the truth was that happened.

Hi Dimples how are you? I know all of this is overwhelming. From reading your post, I can sort of figure out what's going on by reading through the lines. You don't have to further explain if you don't want to (I wouldn't NOT especially here). I will tell you though this will come up at the interview and all your fiance can do at that time is explain what he can to the best of his memory. I will agree with some that the US cannot hold on to a Jamaican passport (especially) if the person is being sent back to their home the next day. That's just from experience from friends. All he can do is prepare for this to come up at the interview. I know you want to have all the information ahead of time, but you may not get all of it. When I went for my husband's interview in 2008 at the US embassy in Jamaica they had all of my paperwork from the early 80s in front of them and they did ask me questions and that was years ago. You get what I'm saying. All he can do is try and explain what happened when he was 16 at POE. Wishing ya'll the best.

Thanks for ur response i needed that..we r being advised by a lawyer now so i feel better. He was sent back the same day,he never left airport but anyway he will have a statement ready for when he is asked..thx

To your question POE will not have the information after 7 years why your fiancé was refused an entry. Even if they had they would not give you any information as it would be considered personal information and only person can request it would be your fiancé or his lawyer.

Some of your post you mentioned you know what your fiancé did wrong – if you already know what he did wrong then there is no point in requesting the same information from USCIS.

Just be truthful this time and let the CO or officer at POE know what he did and he has moved on.

Is it going to be simple journey for him, you and me both know that is not going to be smooth and simple for him.

Now, how do you get a fake visa in a real passport?

If CBP thinks your passport or entry documents are fraudulent, and they decide to simply deny you entry rather than prosecute you for attempting to use fraudulent entry documents, then they'll seize your passport and turn it over to your country's embassy. If they decide to prosecute you then they'll keep your passport as evidence. If you're convicted then you'll never get it back.

OP - if he was denied entry, he was probably finger-printed. When they run his fingerprints at the consulate, they'll know exactly what happened. He should disclose to the best of his knowledge what happened
