Calling to ask what happened years ago will be futile

You can file an FOIA with the Customs and Border Patrol to get the information on her file but that takes months

Has anyone ever called POE to find out exactly what denial at POE was about? Fiance denied when 16 and has no documentation, can you call them to get details?

Finace can not recollect the reason? I believe by law they are supposed to give a reason for denying entry... :blink:

He knows why denied as they told him, but he has no documentation. They took his passport. We want to make sure that what he remembers is what they documented. We don't want to be accused of misrepresentation.

Did they give it back? Was there anything written in it? Where was he denied? What did they tell him was the reason?

They did not give passport back and he was sent back to his country on next flight. Happened at jfk. Visa was either expired or not his. He did admit to something and they kept passport, but said he can return to US in 4 yrs which was 7 yrs ago. Is that enough of an explanation for ds-230? what if he's asked additional info regarding what happen and doesnt know the answer? will they hold against him? he was a minor.

An expired visa is not likely to cause confiscation of the passport. The 'not his' part is most likely.

Yes, they will hold it against him, and he probably had a visa that was not valid or the passport was in someone elses name. I believe he knows what happen, this is something you and him needs to discuss. Not passing judgement, but I do do the climate.

The passport was his , but can visa be denied for something that happened as a minor in which he is truthful about on application? as long as he explains and it matches up to what is in system what is the problem?

These are the facts as you explained it " They did not give passport back and he was sent back to his country on next flight". If the passport was his, they would have given it back with the visa cancelled. Therefore, this leads me to belive that the passport was not in his name.

The US cannot hold another countries passport hostage if the passport is valid. Therefore this passport must have been invalid.

It seems your fiance is still holding some cards to his chest. The United States has no right to confiscate a legitimate international passport from the rightful owner. They can only sieze a U.S passport being used fraudulently or if the passport your fiance tried using belonged to a citizen from a different country than him. If it was a case of just expired visa, the airline wouldn't have let him board in the first place. It could also be that CBP officers saw him as trying to enter with fraudulent documents which would have made his entry illegal. They have the right to take away that document since technically, it wasn't produced by any Government and not a genuine property of any country.

The passport was valid not visa but they kept both. I will discuss with a lawyer. thanks for input. I dont even know what visa looks like, is it a stamp in passport, separate document?

A visa looks like a money with some informations about a person who was issued a visa and glued in visa page of the passport.

01/18/2011 - Interview. APPROVED!!! No words can express how happy i am.

01/25/2011 - VISA in hand! YAY!!!

02/20/2011 - POE Chicago (O'hare)

05/14/2011 - Our Wedding day
