Timeline

Well all my siblings are here. My mom wants to apply for her brothers and sisters. She's an American Citizen. What is the time frame? I read 10+ years? Is that true? Also, when she sends the I-130, I know each of her siblings need to have their own I-130 but what about their respective families (spouse and kids)? Do they need a seperate I-130 or are those included in the sibling's form?

Another question is, one of my aunt, her husband, and kids has been sponsored by her SIL about 10 years ago. She has gotten an NVC number (which won't work when I try to find the case by the way).....from here, how long is the process?

The time frame currently as of today is approx. 11-12 years. The current cut off date is 01JAN00 meaning they are working on cased FILED prior to this date so yes it is true.

Your mom can ONLY petition for her direct family member - Siblings. Their Spouses/Children WILL NOT need a form I-130 since she cannot file for them. The good news is THEY will benefit they will be considered derivatives. Once the petition is approved they WILL require to pay the Visa fee for just an example. Your mom submits the case for her sister she is married and had lets say 3 children. She will submit form and pay $420.00 that's it. After the case is approved and at the NVC stage she will pay $404.00 x 5 = $2020.00.

#2 About your Aunt's case just check to confirm firm the number you are entering are correct. A SIL (sister/son?) cannot sponsor anyone so was the petition submitted by her Sister or Son..? It seems as though it would be her sister if the husband and children are all at the NVC stage. How long they have would depend on their priority date listed on the NOA2 sent by USCIS or you can obtain by calling and speaking with one of the agents at the NVC.

May 17 2013 - Interview-Approved

July 19 2013 - Enter the USA
